While the Committee does not mention article 6, paragraph 2, in the absence of any other explanation it would seem that the Committee has doubts about the compatibility with the Covenant of imposition of the death sentence for murder (the category of crime for which the death sentence is mandatory in the law of the State party).

7.2 Regarding the claim under article 6, paragraph 2, of the Covenant, the Committee observes that, in response to the State party's argument that the Committee's function is not to assess the constitutionality of a State party's law, its task is rather to determine the consistency with the Covenant of the particular claims brought before it.
7-2 وفيما يتعلق بالادعاء بموجب الفقرة 2 من المادة 6 من العهد،، وردا على حجة الدولة الطرف بأن مهمة اللجنة ليست تقييم دستوريّة قانون معمول به في الدولة الطرف، تلاحظ اللجنة أن مهمتها هي تحديد مدى اتساق الادعاء المقدم لها مع العهد(9).

14. As for the compatibility with the Covenant of the definitions of terrorism contained in domestic law and congressional authorization of recourse to military force (question No. 3), it must be recalled that the Covenant contained no provision governing the manner in which a State party was supposed to define the term " terrorism " in its internal law.
14- أما فيما يتعلق بالتوافق مع العهد بالنسبة لتعاريف الإرهاب الواردة في القانون الداخلي والترخيص من جانب الكونغرس للجوء إلى القوة العسكرية (المسألة 3)، يجدر التذكير بأن العهد لا يتضمن أي حكم ناظم للطريقة التي يفترض لدولة طرف أن تعرّف بها مصطلح " الإرهاب " في قانونها الداخلي.

The majority's Views dismiss the State party's arguments, stating merely that " the Committee considers that, whatever the argument, it is competent to consider the compatibility with the Covenant of the national measures taken to implement a resolution of the United Nations Security Council " (para. 10.6, emphasis added).
وترفض أغلبية أعضاء اللجنة، في آرائهم، حجج الدولة الطرف مكتفية بالقول " إن اللجنة تعتبر أن لها، بصرف النظر عن هذه الحجة، اختصاص النظر في مدى تواؤم التدابير المتخذة على الصعيد الوطني لتنفيذ قرار من قرارات مجلس الأمن مع العهد " (الفقرة 10-6 التوكيد مضاف).
