In addition, it was observed that the recommendation in paragraph 32 (d) was compatible with the Guide in that it set forth a default rule for the rights of the parties within the limits of the applicable law.

As to the recommendation in paragraph 32 (e), it was said that the recommendation was compatible with the Guide to the extent it emphasized the importance of valuation of marks without suggesting any particular system of valuation.

After discussion, the Working Group tentatively agreed that the draft Registry Guide should be presented in the form of a separate, stand-alone, comprehensive text that would be consistent with the Guide, refer selectively to the Guide and be tentatively entitled " Technical Legislative Guide on the Implementation of a Security Rights Registry " .

The Working Group engaged in a discussion of the recommendations made by the International Trademark Association concerning the registration of security rights in marks (i.e. trademarks and service marks) with a view to determining their compatibility with the Guide.
80- شرع الفريق العامل في مناقشة بشأن التوصيات التي وضعتها الرابطة الدولية للعلامات التجارية فيما يتعلق بتسجيل الحقوق الضمانية في العلامات (أي العلامات التجارية وعلامات الخدمات)، بغية تحديد مدى توافقها مع الدليل.

It was stated that the recommendations made in paragraphs 32 (a), (b), (f) and (g), dealing with third-party effectiveness of a security right in a mark, were compatible with the Guide in that they promoted the objectives of transparency and registration in a specialized registry or a general security rights or other commercial registry.
81- وذُكر أن التوصيات الواردة في الفقرات 32 (أ) و(ب) و(و) و(ز)، التي تتناول نفاذ الحق الضماني في العلامة تجاه الأطراف الثالثة، تتوافق مع الدليل من حيث إنها تعزّز هدفي الشفافية والتسجيل في سجل متخصص أو سجل عام للحقوق الضمانية أو سجل تجاري آخر.

Another view was that the commentary of the Guide discussed the possibility of supplementary asset-based indexing with respect to high-value, durable assets for which there was a resale market (but not inventory; see the Guide, chapter IV, paras. 34-36), and thus the commentary of the registration text should also discuss the matter in a way that would be consistent with the Guide.

At that session, the Working Group adopted the working assumption that the text would take the form of a guide on the implementation of a registry of notices with respect to security rights in movable assets and that the text should be consistent with the Guide, while, at the same time, taking into account the approaches taken in modern security rights registration systems, national and international (A/CN.9/714, para. 13).
