Two basic elements have to be considered: firstly, that the work or service extracted was done under threat or penalty and, secondly, that the work was done involuntarily.

Article 2, paragraph 1, of that Convention defines " forced labour or services " as: " All work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily. "
فالفقرة 1 من المادة 2 من هذه الاتفاقية تعرِّف " الأعمال أو الخدمات القسرية " بأنها: " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوّع هذا الشخص لأدائها بمحض اختياره " .

1. For the purposes of this Convention the expression " forced or compulsory labour " shall mean all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily.
١ - في مصطلح هذه الاتفاقية، تعني عبارة " عمل السخرة أو العمل القسري " جميع اﻷعمال أو الخدمات التي تفرض عنوة على أي شخص تحت التهديد بأي عقاب، والتي لا يكون هذا الشخص قد تطوع بأدائها بمحض اختياره.

The Convention also makes an exception for work or service required in genuine cases of emergency and forming part of normal civic obligations of citizens in a fully self-governing country.
وتستثني الاتفاقية أيضا العمل أو الخدمة في حالات الطوارئ القاهرة والعمل أو الخدمة اللذي يشكلان جزءا من واجبات المواطنين المدنية العادية في بلدية يتمتع بالحكم الذاتي الكامل.

In accordance with article 8, forced or compulsory labour means all work or service exacted from any person under threat of punishment and which the person has not voluntarily offered to perform.
وتعرِّف هذه المادة العمل القسري أو الإلزامي على أنه أي عمل أو خدمة تُفرض عنوة على أي شخص تحت التهديد بالعقوبة دون أن يكون الشخص المعني قد تطوع بذلك من تلقاء نفسه.

Furthermore, the Constitution of Samoa stipulates that labour shall not include any work or service which is required by Samoan custom or which forms part of normal civic obligations.
وعلاوة على ذلك، ينص دستور ساموا على أن مصطلح العمل لا يشمل أي عمل أو خدمة تشكل جزءاً من عادات ساموا أو جزءاً من واجبات المواطنين المدنية العادية.

(c) “Forced labour”shall mean all work or service exacted from any person under the threat or use of force [, directly or indirectly] or through the use of coercion, and for which the person does not give free and informed consent [, except:
)ج( تعني " السخرة " كل عمل أو خدمة ينتزع من أي شخص بواسطة التهديد بالقوة أو باستعمالها ]، بصورة مباشرة أو غير مباشرة[ أو بالقسر، دون أن يبدي ذلك الشخص قبوله بذلك عن حرية وادراك ]، باستثناء:

(ii) Any work or service not referred to in subparagraph (a) of this article that is normally required of a person who is under detention in consequence of a lawful order of a court, or of a person during conditional release from such detention;
' ٢ ' أي عمل أو خدمة غير مشار اليها في الفقرة الفرعية )أ( من هذه المادة يفرض أداؤها على شخص خاضع للاحتجاز بمقتضى أمر قانوني صادر عن محكمة، أو على شخص أفرج عنه افراجا مشروطا أثناء ذلك الاحتجاز؛

The expression " forced or compulsory labour " refers to any work or service required of an individual under threat of any type of punishment and to which that individual has not agreed of his own free will.
وتعني عبارة " عمل السخرة أو العمل الالزامي " كل عمل أو خدمة يطالب شخص ما بتأديتهما دون رغبة منه مع تهديده بمعاقبته إن لم يستجب.

International Labour Organization (ILO) Convention (No. 29) concerning Forced Labour defines " forced or compulsory labour " as all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily (art. 2).
أما الاتفاقية رقم ٩٢ الصادرة عن منظمة العمل الدولية والمتعلقة بالعمل الجبري، فإنها تقصد بتعبير " العمل الجبري أو الالزامي " كل أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص ﻷدائها بمحض اختياره )المادة ٢(.

The Committee further noted that under the Labour Code of 1992, the term " forced or compulsory labour " does not include any work or service in the general interest forming part of the civic obligations of citizens as defined by the laws and regulations.
ولاحظت اللجنة أيضاً أنه بموجب قانون العمل الصادر في عام 1992 لا يشمل " العمل الجبري أو القسري " أي أعمال أو خدمات للمصلحة العامة كجزء من الالتزامات المدنية للمواطنين على النحو المنصوص عليه في القوانين واللوائح.

9. The International Labour Organization defines forced labour as " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
9- وتعرِّف منظمة العمل الدولية العمل الجبري على أنه " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص لأدائها بمحض اختياره " ().

4.11 The State party observes that the Covenant's exception for " any work or service which forms part of normal civic obligations " is not specifically defined, but should be interpreted against the backdrop of the minimum standards contained in ILO Convention No. 29.
4-11 وتلاحظ الدولة الطرف أن استثناء " أي أعمال أو خدمات تشكل جزءاً من الالتزامات المدنية العادية " في العهد غير معرّفٍ بدقة، ولكن ينبغي تفسيره على خلفية المعايير الدنيا المدرجة في اتفاقية منظمة العمل الدولية رقم 29.

The amount payable in respect of any preliminary items, so far as the work or service comprised therein has been carried out or performed, and a proper proportion as certified by the Engineer of any such items the work or service comprised in which has been partially carried out or performed.
(أ) المبلغ المستحق فيما يتعلق بأي بنود أولية، طالما تكون الأعمال أو الخدمات المدرجة فيها قد نفذت أو اضطلع بها، وبقدر ما يكون قد تم جزئياً، تنفيذ أو أداء جزء معقول من الأعمال أو الخدمات المدرجة في أي بند من هذه البنود، وفقاً لشهادة المهندس.

66. Forced labour, which is defined as work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself or herself voluntarily, is prohibited by the Labour Code Order, 1992.
٦٦- وجاء حظر عمل السخرة بموجب قانون العمل لسنة ٢٩٩١، ويعرّف بأنه جميع اﻷعمال أو الخدمات التي تفرض عنوة على أي شخص تحت تهديد بأي عقاب، والتي لا يكون هذا الشخص قد تطوع بأدائها بمحض اختياره.

work or service exacted in virtue of compulsory military service laws for work of a purely military character is exempted from the provisions.
ويستثنى من أحكام الاتفاقية العمل أو الخدمة المفروضة بمقتضى قوانين الخدمة العسكرية اﻹلزامية لتنفيذ أعمال ذات صبغة عسكرية بحتة.

(a) Any work or service not referred to in paragraph 3 of the present article normally required of a person who is under detention in consequence of a lawful order of a court or of a person during conditional release from such detention;
