The Minister further explained that all death sentences had to be signed by the Minister of Justice, as well as by the President; that the only method of carrying out the death sentence was by hanging, and that the only place death sentences were carried out was in the execution chamber of the Abu Ghraib prison, close to Baghdad.

Dans une affaire marquante jugée en 1998, National Coalition for Gay and Lesbian Equality and another v. Minister of Justice and others, la Cour constitutionnelle d'Afrique du Sud, soulignant le droit de toutes les personnes à la dignité et l'égalité, a invalidé trois lois distinctes sur la sodomie et conclu que la discrimination fondée sur l'orientation sexuelle était interdite par la Constitution de l'Afrique du Sud.
