On 11 May 2000, the State party informed the Committee that on 31 March 2000, Mr. Arutyunyan's death sentence had been commuted to 20 years' imprisonment.

5.7 The Committee has noted the author's claim that the trial of Mr. Arutyunyan was unfair.

Following a Presidential Decree of 26 September 2003 on the liberalization of prison sentences for first-time offenders, Mr. Arutyunyan had been transferred to an ordinary-regime colony.
وعقب صدور المرسوم الرئاسي في 26 أيلول/سبتمبر 2003 المتعلق بتخفيف أحكام السجن على مرتكبي جرم ما لأول مرة، تم نقل السيد أروتيونيان إلى معتقل ذي نظام عادي.

Mr. Arutyunyan was a member of the Uzbek rock band " AlVakil " .

By judgement of 3 November 1999, Messrs. Arutyunyan and Siragev were found guilty of having murdered Mrs. Alieva and robbed her of her jewellery, and were sentenced to death by the Tashkent City Court.
2-2 وبموجب حكم صدر في 3 تشرين الثاني/نوفمبر 1999، قضت محكمة مدينة طشقند بإدانة السيدين أروتيونيان وسيراجيف لقتلهما السيدة آلييفا وسرقة مجوهراتها، وحكمت عليهما بعقوبة الإعدام.

It is alleged that both Messrs. Arutyunyan and Siragev were mistreated and tortured during the investigation to make them confess, to the extent that Mr. Siragev had to be hospitalized.
3-2 ويُدعى أن السيدين أروتيونيان وسيراجيف قد أُسيئت معاملتهما وتعرضا للتعذيب أثناء التحقيقات لإكراههما على الاعتراف، وبأن ذلك بلغ حداً أُدخل على إثره السيد سيراجيف المستشفى.

Allegedly, Mr. Arutyunyan was initially prevented from making use of the services of a counsel hired by his family, under the pretext that no procedural action had yet been initiated.
3-4 ويُدعى أن السيد أروتيونيان قد مُنع في بادئ الأمر من الاستعانة بخدمات محامٍ تعاقدت معه أسرته بذريعة عدم اتخاذ أي إجراءٍ بعد.

5.9 The author claims that Mr. Arutyunyan was beaten and tortured by the investigators to make him confess, contrary to article 7 of the Covenant.
5-9 وتدعي صاحبة البلاغ أن السيد أروتيونيان قد تعرض للضرب والتعذيب على أيدي المحققين لإكراهه على الاعتراف، وهو أمر يتنافى ومضمون المادة 7 من العهد.
