It came to this conclusion on the grounds that the author: had not established his identity; lacked credibility, in that he provided contradictory information and; failed to establish a fear of persecution and the unavailability of protection in Pakistan.

On 29 September 2008, the Constitutional Court found the application inadmissible on the grounds that the author had failed to show that the case had particular constitutional significance, and dismissed it.
وفي 29 أيلول/سبتمبر 2008، قضت المحكمة الدستورية بعدم مقبولية الطلب على أساس أن صاحب البلاغ لم يبرهن على أن للقضية وجاهةً دستورية محددة، فرفضتها.

It is to be pointed out that the finding was not made on the basis that Canada was a party to the Second Optional Protocol, which it is not, nor on the basis that the author would risk a violation of article 6 in the receiving country.

4.5 Finally, the State party contends that as far as the author's complaint about the judgement of the Cour d'assises de la Manche of 19 September 1989 is concerned, available domestic remedies have not been exhausted, on the basis that the author failed to substantiate his grounds of appeal before the Court of Cassation.
٤-٥ وأخيرا، تحاجي الدولة الطرف بأنه فيما يتعلق بشكوى صاحب البلاغ بشأن حكم محكمة الجنايات العليا لمنطقة المانش بتاريخ ٩١ أيلول/سبتمبر ٩٨٩١، فإن وسائل الانتصاف المحلية المتاحة لم تستنفد بعد، على أساس أن صاحب البلاغ لم يثبت سلامة اﻷسس التي أقام عليها استئنافه أمام محكمة النقض.
