The legal qualification of the author's actions under article 193 - 6 of the Code on Administrative Offences was correct, and the primary penalty (a minimal fine) was imposed taking into account the extenuating circumstances referred to by the author.

وتلاحظ الدولة الطرف أيضا أن السابقة القضائية للمحكمة اﻷوروبية لحقوق اﻹنسان التي أشار إليها صاحب البلاغ لا تطبق بصورة مطلقة وتناولها عدد من التغييرات )ولا سيما في الحكم المتعلق بـ " ساريفا دي كارفالهو " )٣٥(.

It is clear from the judgement that the Supreme Court looked at the author's allegations in great detail and considered the evidence submitted in the trial and referred to by the author in his appeal, and found that there was sufficient incriminating evidence to rule out errors in weighing the evidence and set aside the presumption of innocence in the author's case.

7.5 The State party further considers that the cases referred to by the author are not relevant to the case at hand: the Aboushanif case did not concern a violation of the Limited Liability Companies Act and the Taxquet case is different insofar as it did not concern the right to a substantial review, but whether grounds had to be given under article 6, paragraph 1, of the European Convention on Human Rights with regard to the verdict of a jury.
