Article 28 (1) stipulates that indigenous peoples have the right to get back or be compensated when the lands, territories or resources have been wrongly taken away, occupied, used or damaged without their free, prior and informed consent.
وتنص الفقرة (1) من المادة 28 على أن للشعوب الأصلية الحق في العودة أو التعويض عندما تكون أراضيها أو أقاليمها أو مواردها قد أخذت عن طريق الخطأ أو احتلت أو استخدمت أو أضيرت دون موافقتها الحرة والمسبقة والمستنيرة.

The Declaration provides, in its article 8 (2) (b), that States should prohibit " any action which has the aim or effect of dispossessing [indigenous peoples] of their lands, territories or resources " , a requirement that replicates article 18 of ILO Convention No. 169.
وينص الإعلان في مادته 8 (2) (ب) على أنه ينبغي للدول أن تمنع " أي عمل يهدف أو يؤدي إلى نزع ملكية أراضي [الشعوب الأصلية] أو أقاليمها أو مواردها " ، وهذا بند يطابق مضمونه ما جاء في المادة 18 من اتفاقية منظمة العمل الدولية رقم 169.

Under article 8, paragraph 2 (b), of the United Nations Declaration on the Rights of Indigenous Peoples, " States shall provide effective mechanisms for prevention of, and redress for, ... any action which has the aim or effect of dispossessing [indigenous peoples] of their lands, territories or resources. "
وبموجب المادة 8 (الفقرة الفرعية 2(ب)) من إعلان الأمم المتحدة بشـأن حقوق الشعوب الأصلية، " على الدول أن تضع آليات فعالة لمنع ما يلي والانتصاف منه [...] أي عمل يهدف أو يؤدي إلى نزع ملكية [الشعوب الأصلية ﻟ] أراضيها أو أقاليمها أو مواردها " .

In accordance with the Declaration, indigenous peoples are entitled to redress when development projects affect their lands, territories or resources (article 32(3)), which includes restitution and/or compensation for the lands, territories and resources that have been confiscated, taken, occupied, used or damaged without their free, prior and informed consent (article 28(1)).
