وتلاحظ اللجنة أن صاحب الشكوى قدم دليلاً وثائقياً على سبق تعرضه للتحقيق والمقاضاة بوصفه من المناضلين السيخ، وأنه عيِّن أميناً عاماً لمكتب حزب أكالي دال في هاريانا، وأنه كان يعمل كاهناً لطائفة السيخ.

However, the Committee notes that the complainant contends he was detained and tortured because he was accused of being a militant, that despite his formal acquittal by the courts, the police continued to harass him, that he is well known to the authorities because of his activities as a Sikh priest, his political involvement with Akali Dal party and his leadership role in the local structures of the party.

62. All the newly reported cases occurred in the province of Punjab, and concerned the mother of the Chief General of the Khalistan Commando Force, the Secretary-General of the human rights wing of the Akali Dal political party, a father and his daughter whose husband was wanted by the police, and other members of the Sikh community suspected by the Indian security forces of secessionist activities.
٢٦- وجميع الحالات التي أُبلغ عنها حديثاً شهدها إقليم البنجاب، وتتعلق بوالدة القائد العام لقوة فدائيي خالستان واﻷمين العام لجناح حقوق اﻹنسان لحزب أكالي دال السياسي وأب وابنته التي كان زوجها ملاحقاً من جانب الشرطة وأفراد آخرين في طائفة السيخ تشتبه قوات اﻷمن الهندية في أنهم يضطلعون بأنشطة انفصالية.

5-7 ويعترض صاحب الشكوى على ما أكدته الدولة الطرف من أن إفلات مرتكبي التعذيب من العقاب قد انتهى زمنه، ويدعم رأيه بوصف عدة حالات احتُجز فيها مدافعون عن حقوق الإنسان أو ناشطون أعضاء في حزب أكالي دال وعُذبوا على يد الشرطة.

The complainant also refers to the 2005 report of the organization ENSAAF, entitled Punjab Police: Fabricating Terrorism through Illegal Detention and Torture, which talks about large quantity of arbitrary detentions in the period June-August 2005, including a leader of Akali Dal.
