12. In the discussion, regional instruments for the protection of indigenous human rights were assessed. Attention was drawn to the decision of the Inter-American Court of Human Rights in the Awas Tingni case in Nicaragua.

11. Finally, following up on the decision of the Inter-American Court, the Government was taking steps to move forward the process aimed at providing land titles to the Awas Tingni.

In December 2008, the Special Rapporteur was invited to attend a ceremony in Awas Tingni, Nicaragua, during which the Government handed over to that indigenous community the much-awaited title to its ancestral lands, as required by a 2001 judgement of the Inter-American Court of Human Rights.

The international law and jurisprudence that has developed in the Awas Tingni case, in the Maya Indigenous Communities case, in Convention No. 169, and elsewhere, is the law that must be applied by States to determine what land and territories, and therefore what resources, belong to indigenous peoples.
