26 - [إذا كشفت عملية الإستعراض بموجب المادة 8 مسألة إمتثال طرف لمعايير الأهلية للإتجار في الإنبعاثات بموجب المادة 17، جاز له مواصلة نقل وحيازة [وحدات الكمية المسندة] [أجزاء من الكمية المسندة] بعد تحديد المسألة، بشرط ألا يستخدم هذه الوحدات طرف آخر للوفاء بإلتزاماته بموجب المادة 3 إلى أن تحل مسألة الإمتثال لصالح الطرف المعني.

Option 4: `Trigger': If a question is raised concerning a Party's compliance with its commitments under Article 3 and the Party is subsequently found to be in non-compliance, any [AAUs] [PAAs] that have been transferred to other Parties under the provisions of Article 17 after the point in time at which the question was raised shall be invalidated and cannot be used for the purpose of meeting commitments under Article 3, or further traded.

To recall that, in accordance with decision XVI/39, the Committee will review Turkmenistan's compliance status in 2005 by reference to the Protocol's control measures for Parties operating under Article 5, which require Turkmenistan to reduce its CFC consumption in 2005 to 18.666 ODP tonnes in order to achieve compliance in that year.
(د) أن تشير كذلك إلى أنه، طبقاً للمقرر 16/39، ستقوم اللجنة بإستعراض حالة إمتثال تركمانستان في 2005 فيما يتعلق بالتدابير الرقابية للبروتوكول بالنسبة للأطراف العاملة بموجب المادة 5، مما يستلزم قيام تركمانستان بخفض استهلاكها من مركبات الكربون الكلورية فلورية في 2005 إلى 666,18 طن محسوبة بدالات إستنفاد الأوزون من أجل تحقيق الامتثال في هذه السنة.
