4.1 The State party confirms that quarrying of stone in the area claimed by the authors was made possible by a permit granted by the Angeli Municipal Board on 8 January 1990.
٤-١ تؤكد الدولة الطرف أن نشاط استخراج الحجارة من المنطقة التي يدعي مقدمو البلاغ ملكيتها قد أجيز بموجب ترخيص صادر عن المجلس البلدي لمنطقة أنجلي في ٨ كانون الثاني/يناير ٠٩٩١.

As to the authors' request for interim measures of protection, it noted that the application of rule 86 of the rules of procedure would be premature but that the authors retained the right to address another request under rule 86 to the Committee if there were reasonably justified concerns that quarrying might resume.

By comparison, the total area used by the Muotkatunturi Herdsmens' Committee covers 2,586 square kilometres, whereas the area fenced in for quarrying covered only approximately one hectare and is only four kilometres away from the main road.
وبالمقارنة يبلغ مجموع مساحة اﻷراضي التي تستخدمها لجنة رعاة موتكاتونتوري ٥٨٦ ٢ كيلومتر مربع في حين أن مساحة اﻷرض المسيجة ﻷغراض عمليات استخراج الحجارة لم تبلغ إلا هكتارا واحدا تقريبا وهي لا تبعد عن الطريق الرئيسية إلا بمسافة أربعة كيلومترات.

9.6 Against this background, the Committee concludes that quarrying on the slopes of Mount Riutusvaara, in the amount that has already taken place, does not constitute a denial of the authors' right, under article 27, to enjoy their own culture.
٩-٦ وعلى هذا اﻷساس، تستنتج اللجنة أن نشاط استخراج الحجارة من سفوح جبل ريوتوسفارا باﻷحجام التي تم استخراجها بالفعل لا يشكل انكارا لحق مقدمي البلاغ، بموجب أحكام المادة ٧٢ في التمتع بثقافتهم.

7.7 In the above context, the State party notes that it appears from an opinion of the Environmental Office of the Lapland County Administrative Board (dated 8 May 1991) that only low pressure explosives are used to extract stone from the rock: " Extraction is carried out my means of sawing and wedging techniques ... to keep the rock as whole as possible " . As a result, possible harm to the environment remains minor.
٧-٧ وفي السياق المبين أعلاه، تلاحظ الدولة الطرف انه يظهر من رأي صدر عن مكتب البيئة التابع للمجلس الاداري لمقاطعة لابلاند )بتاريخ ٨ أيار/مايو ١٩٩١( انه لا يتم استخدام سوى تفجيرات منخفضة الضغط لاستخراج الحجارة من الصخور: " يتم استخراج الحجارة بواسطة تقنيات النشر والفلق بالاسافين: من أجل ابقاء الصخور كاملة قدر اﻹمكان " ونتيجة لذلك تظل اﻷضرار التي يحتمل ان تلحق بالبيئة طفيفة.
