10.2 The Committee observes that any State party which made the declaration under article 22 of the Convention recognizes the competence of the Committee against Torture to receive and consider complaints from individuals who claim to be victims of violations of the provisions of the Convention.

7.2 It considered that article 1 of the Optional Protocol recognizes the competence of the Committee to receive and rule on communications from individuals who claim to be victims of a violation of any of the rights set forth in the Covenant, and who are subject to the jurisdiction of a State party.

It reiterates that it has not violated the Optional Protocol since it recognizes the competence of the Committee to receive and consider communications submitted directly by individuals who claim to be victims of a violation of a right, but not from a third party, and that it has cooperated with the Committee in a spirit of goodwill and provided it with all the relevant information on the case.

Forty-five States parties had made the declaration under article 14 of the Convention recognizing the competence of the Committee to receive and consider communications from individuals or groups of individuals claiming to be victims of violation by those States parties of any of the rights set forth in the Convention.
