The Special Rapporteur urges the Government to conduct exhaustive and impartial investigations into all allegations of violations of the right to life and bring those responsible to justice.

8.8 Regarding the allegations of violations of human rights during the extradition process, in particular the right to asylum, the State party recalls that this right may not be invoked in the case of prosecutions arising from non-political crimes.

The Committee recalls its jurisprudence that authors must substantiate allegations of violations of their Covenant rights under the Optional Protocol; mere affirmations unbuttressed by substantiating evidence do not suffice.

Yemen 561. The Special Rapporteur transmitted allegations of violations of the right to life on behalf of two identified and six unidentified persons:

It therefore submits that the allegations of a violation of articles 26 and 27 alone and read in conjunction with article 2, paragraphs 1, 2 and 3 are ill-founded.

(c) The failure to conduct prompt and impartial investigations into such allegations of breaches of the Convention; and

As for the allegations concerning a violation of article 18, the Committee considers that they cannot be dissociated from the author's allegations under article 7, which must be determined on the merits.
أما بخصوص الادعاءات المتعلقة بانتهاك المادة 18، فترى اللجنة أنها لا يمكن أن تُفصل عن ادعاءات صاحب البلاغ بموجب المادة 7، التي يجب البت فيها من حيث الأسس الموضوعية.

9.3 As to the allegations concerning the violation of article 12 of the Convention, the Committee notes that according to the complainant the State party failed to investigate his claims that he was subjected to torture while in detention.
9-3 وفيما يخص الادعاءات المتعلقة بانتهاك المادة 12 من الاتفاقية، تلاحظ اللجنة أنه وفقاً لصاحب الشكوى فإن الدولة الطرف لم تجر تحقيقات في ادعاءات تعرضه للتعذيب أثناء الاحتجاز.

Having reached this conclusion, the Committee will not examine the claims regarding the violation of article 10 for the same facts.

The Committee is, therefore, incompetent to consider communications that allege violations of other instruments.
