Kuwait proposes to remediate the OB/OD sites by instituting a cleaning and restoration programme consisting of:

The third claim unit relates to future measures to remediate damage to terrestrial ecosystems at seven open burning/open detonation ( " OB/OD " ) sites.
195- وتتعلق المطالبة الثالثة بالتدابير التي تعتزم الكويت اتخاذها مستقبلاً لإصلاح الضرر الذي لحق بالنظم البيئية الأرضية في سبعة من مواقع الحريق المكشوف/التفجير المكشوف.

The fourth claim unit relates to future measures to revegetate contaminated and affected areas within the Umm Al Gawati ordnance repository site and the OB/OD sites.
196- وتتعلق المطالبة الرابعة بالتدابير المقرر اتخاذها مستقبلاً لإعادة الغطاء النباتي للمناطق الملوثة والمتأثرة داخل إطار مستودع العتاد العسكري في أم الغواتي ومواقع الحريق المكشوف/التفجير المكشوف.

Kuwait claims that disposal of mines and unexploded ordnance in OB/OD sites resulted in the presence of residual explosives and explosive-related chemicals at levels that are a potential threat to human health and the environment.
220- وتدعي الكويت أن التخلص من الألغام والذخائر غير المتفجرة في مواقع الحريق المكشوف/التفجير المكشوف أدى إلى وجود بقايا المتفجرات والمواد الكيميائية المرتبطة بالتفجير بمستويات تمثل تهديداً محتملاً للصحة البشرية والبيئية.

Kuwait states that disposal of the mines and unexploded ordnance was necessary to mitigate a " lethal threat " to the population of Kuwait and that the use of OB/OD sites was the safest, most efficient and most cost-effective approach for achieving this objective.
223- وتقرر الكويت أن التخلص من الألغام والذخائر التي لم تنفجر كان ضرورياً للتخفيف من " الخطر القاتل " على سكان الكويت، وأن استخدام مواقع الحريق المكشوف/التفجير المكشوف كان أكثر المناهج أمناً وكفاءة وفعالية بالنسبة للتكلفة لتحقيق هذا الغرض.

Kuwait claims that 15 per cent of the total land area of 70,000 square metres at the seven OB/OD sites has been affected by the contamination.

Iraq also argues that the use of OB/OD sites is a standard and widely used method for disposing of live ordnance, and that it does not cause any soil contamination that would require remediation.

226- كما يزعم العراق أن ادعاء الكويت وجود تلوث في التربة عند مواقع الحريق المكشوف/التفجير المكشوف يستند إلى أبحاث عن التلوث في المواقع العسكرية في الولايات المتحدة، حيث أدت عقود من سوء الاستخدام وسوء إدارة النفايات إلى تلوث التربة والمياه الجوفية.

However, the Panel notes that Kuwait has submitted evidence of damage in respect of only three OB/OD sites, covering approximately 30,000 square metres.

As stated in paragraph , the Panel finds that the damage resulting from the destruction and disposal of ordnance at the OB/OD sites is a direct result of Iraq's invasion and occupation of Kuwait.
237- وكما ذكرنا في الفقرة 227 يجد الفريق أن الضرر الناشئ عن تدمير العتاد والتخلص منه في مواقع الحريق المكشوف/التفجير المكشوف هو نتيجة مباشرة لغزو العراق واحتلاله للكويت.

Accordingly, the Panel recommends no compensation for future measures to revegetate contaminated and affected areas within the OB/OD sites.
238- وبالتالي لا يوصي الفريق بتعويض مقابل التكاليف التي يزمع اتخاذها في المستقبل لإعادة تغطية المناطق الملوثة والمتأثرة داخل مواقع الحريق المكشوف/التفجير المكشوف بالنباتات.

This should be adequate to promote natural recovery of vegetation and ecological functions across the small areas that will be disturbed at the OB/OD sites.
