42. The lack of a reasoned, clear and accurate statement of the alleged facts and the absence of a description of the circumstances of the alleged acts adversely affect Mr. López Mendoza's right to a defence and due process.
٤٢- ويؤثر عدم تعليل الوقائع المزعومة وعرضها بأسلوب واضح ودقيق وعدم توصيف ظروف الأفعال التي ادعي ارتكابها تأثيراً سلبياً على حق السيد لوبيز ميندوزا في الدفاع وفي مراعاة الأصول القانونية.

The author also claimed that the main purpose of the new charge was to prevent his release, and that his right to be presumed innocent, his right to a defence and his right to a fair trial had been violated as he had been convicted without sufficient evidence.
