But in many situations there was a de facto choice and the question of the identification of the injured State arose in that context. It might be that the injured State could call on the wrongdoing State for cessation of the wrongful act, but others could not.

Attention was, however, drawn to the fact that countermeasures were the means by which a State could bring about the cessation of a wrongful act, or the conclusion of an agreement to resolve a dispute peacefully, and that placing excessive burdens on the injured State would only strengthen the position of the wrongdoing State.

The idea is to exclude demands compliance with which would affect, rather than just the dignity, the existence and the sovereignty of the wrongdoing State, namely, its independence, its liberty or its form of government.

Notwithstanding its apparent severity, the suggested waiver of the economic stability safeguard would be particularly appropriate in a situation where the wrongdoing State had enhanced its economic prosperity by the very crime it had committed.

He furthermore remarked that, by emphasizing disputes arising from recourse to countermeasures, the draft provisions gave the impression that countermeasures were the root cause of the dispute and not the consequence of the original internationally wrongful act and that such a shift of presumptions, from the wrongdoing State to the injured State, was contrary to the general economy of the proposed system.

The prevailing consideration should be that the wrongdoing State must restore to the fullest possible extent a state of affairs the maintenance of which is of essential interest – in conformity with the notion set forth in article 19 – to the international community - and this even if a heavy burden is thus placed on the State which has jeopardized that state of affairs by infringing fundamental rules of international law.

With all due consideration for economic sovereignty and economic self-determination, it is questionable whether the States injured by a serious infringement of a rule safeguarding an essential interest of the international community should be deprived totally or in part of restitution in kind because such a remedy might jeopardize the stability of the wrongdoing State's economy.
ومع ايلاء كل الاعتبار اللازم للسيادة الاقتصادية والاستقلال الذاتي الاقتصادي، يمكن الشك في صحة حرمان الدول المضرورة من جراء انتهاك خطير لقاعدة تصون مصلحة أساسية " للمجتمع الدولي " ، حرمانا كاملا أو جزئيا، من رد الحق إليها عينا ﻷن مثل هذا السبيل للانتصاف قد يهدد استقرار اقتصاد الدولة مرتكبة الفعل غير المشروع.

Japan considers that the words " seriously jeopardize ... the economic stability " should be clarified, in order to preempt abuses by the wrongdoing State: the deletion of the paragraph, however, would be a solution of last resort as there is, in its view, a need for such a provision in the draft articles.

the wrongdoing State could not in such cases be relieved of the obligation to provide restitution in kind, namely to restore the original situation of the unlawfully exploited population or territory by invoking that compliance with this obligation would have – as it might well have – a substantial negative impact on its economic stability.
