Territorial States should evaluate whether their domestic legal framework is adequate to ensure that the conduct of PMSCs and their personnel is in conformity with relevant national law, international humanitarian law and human rights law or whether it needs to establish further arrangements to regulate the activities of PMSCs.

However, PMSCs and their employees were a gray area not specifically covered by the 1989 Convention.

To this end they have the obligation, in specific circumstances, to take appropriate measures to prevent, investigate and provide effective remedies for relevant misconduct of PMSCs and their personnel.

1. Each State party shall take such legislative, judicial, administrative and other measures as may be necessary to ensure that PMSCs and their personnel carry out their activities exclusively under the respective licences and authorizations.
1- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية وغيرها لضمان عدم قيام الشركات العسكرية والأمنية الخاصة وموظفيها بأنشطتهم إلا بموجب الرخص والتصاريح ذات الصلة.

1. Each State party shall ensure that the acts of carrying out inherently State functions, as specified in article 9 of this Convention by PMSCs and their personnel are offences under its national law.
1- تكفل كل دولة طرف أن يتضمن قانونها الوطني حكما بتجريم اضطلاع الشركات العسكرية والأمنية الخاصة وموظفيها بوظائف هي بطبيعتها وظائف منوطة بالدولة، على النحو المحدد في المادة 9 من هذه الاتفاقية.

Many national laws did not provide for extraterritorial jurisdiction to hold PMSCs and their personnel criminally responsible for serious violations committed abroad, and existing legislation was often limited in scope, reach and applicability.

5. A representative of ICRC continued dialogue with the Working Group on approaches of international humanitarian law, including the definition of mercenaries and the responsibilities of States with respect to PMSCs and their employees.

38. The Group decided that its initial substantive focus would be on the role of the State as the primary holder of the monopoly of the use of force, and agreements between Governments which led to immunity from accountability for human rights violations by PMSCs and their employees.
