Both the Constitutional Court and the ILO Committee of Experts have established that prior consultation does not imply a right to veto State decisions, but that it is an ideal mechanism for enabling indigenous and tribal peoples to exercise the right to express themselves and to influence the decision-making process.

24. The ILO approach in the area of indigenous and tribal peoples falls within two major areas: (a) supervision of the two conventions relating to indigenous and tribal peoples, and (b) technical assistance.

31. Mr. Aucan Huilcaman, of the Consejo de Todas las Terras in Chile, expressed his concern at the lack of constitutional recognition of the rights of Chile's indigenous people and the failure of its Government to ratify International Labour Organization Convention No. 169 on indigenous and tribal peoples.

Part of this effort was the development of an " Advocacy Framework for Indigenous and tribal peoples' Rights " , which was discussed and finalized with the Inter-agency Support Group on Indigenous Issues and with some members of the Forum.
