The complainant mentions that he did not apply to the High Court of Australia for special leave to appeal the judgment of the Federal Court as it would not have constituted an effective remedy, because the Federal Court had already determined it was unable to consider merits arguments.

However, they must ensure that substantive questions concerning the merits of the case -- such as evidence of damage or a close causal relationship between the damage and the alleged conduct -- are not mixed up with questions of admissibility of the action in a way that would make it overly burdensome, in practice, to obtain locus standi.
