The adoption by vote of Protocol III was regrettable insofar as it had failed to take into account the reservations expressed during the negotiation of the draft, thereby setting an undesirable precedent in matters relating to international humanitarian law.

The universalization and full implementation of the Protocol, together with continued work on international humanitarian law within the framework of the Convention, should make it possible to address the humanitarian impact of all types of explosive remnants of war, including cluster munitions, which could become a threat to civilian populations.

In such cases, draft article 17 makes it clear that the rules and principles governing armed conflict apply, including various provisions of conventions on international humanitarian law to the extent that the States in question are bound by them.

8- وتواصل اللجنة الدولية للصليب الأحمر دعم عالمية الاتفاقية وبروتوكولاتها عن طريق إدراج هذه المسألة في اجتماعاتها الإقليمية ومناقشاتها الثنائية مع الحكومات وفي الحلقات الدراسية الإقليمية المتعلقة بالقانون الدولي الإنساني.

It is pursuant to that article that jurisdiction has been attributed to Spanish courts under article 23.4 (h) of Organic Law No. 6/1995, which gives them jurisdiction over " any other [offence] which, according to international treaties and agreements, particularly those relating to international humanitarian and human rights law, is to be prosecuted in Spain " .
فبموجب هذه المادة أسندت الولاية القضائية للمحاكم الإسبانية وفقاً للفقرة (ح) من المادة 23.4 من القانون الأساسي رقم 6/1995، التي تمنح المحاكم الولاية القضائية على " أي جريمة أخرى تحاكم في إسبانيا وفقاً للمعاهدات والاتفاقيات الدولية، لاسيما تلك المتعلقة بالقانون الدولي الإنساني وقانون حقوق الإنسان " .
