Iceland is willing to engage in a constructive debate for the purpose of finding fair and equitable practical solutions regarding the exploitation of marine genetic resources in areas beyond national jurisdiction within the existing legal framework.

50. Different views continued to be expressed regarding the regime applicable to marine genetic resources of areas beyond national jurisdiction.

Several delegations expressed the view that access and benefit-sharing related to marine genetic resources of areas beyond national jurisdiction was a key issue that should be addressed, including in any future normative instrument.

50. Many delegations, however, stressed the need for a regime for the sharing of benefits arising from the utilization of marine genetic resources of areas beyond national jurisdiction.
٥٠ - غير أن وفودا كثيرة شددت على الحاجة إلى وضع نظام لتقاسم المنافع المتأتية من استخدام الموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية.

An observation was made that none of the existing approaches to benefit-sharing could be applied to marine genetic resources of areas beyond national jurisdiction, where resources were not subject to case-by-case mutually agreed terms, but where the users and providers could span many different sectors.
وأُدلي بملاحظة مفادها أنه لا يمكن تطبيق أي من نُهج تقاسم المنافع المتبعة حاليا على الموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية، إذ أن هذه الموارد لا تخضع لشروط متفق عليها على أساس كل حالة على حدة، بل قد يكون مستخدموها ومقدموها من عدة قطاعات مختلفة.

48. Some other delegations reiterated their view that the principle of the common heritage of mankind did not apply to marine genetic resources of areas beyond national jurisdiction, and that the freedom of the high seas applied to those resources instead.
٤٨ - وأكدت وفود أخرى مجددا رأيها القائل بأن مبدأ التراث المشترك للإنسانية لا ينطبق على الموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية، بل إن مبدأ حرية أعالي البحار هو الذي ينطبق على هذه الموارد.
