1. Illicitly acquired assets recovered pursuant to this chapter shall be disposed of in accordance with domestic law.

The action decided by the ministers of justice and home affairs in order to help victim States recover illicitly acquired assets is as follows:
وقرر وزراء العدل والداخلية اتخاذ التدابير التالية لمساعدة الدول الضحايا على استرداد الموجودات المكتسبة بطرق غير مشروعة:

Moreover, confiscation impedes illicitly acquired assets from being reinvested into the legitimate economy.
وعلاوة على ذلك، فإنَّ المصادرة تعيق إعادة استثمار الموجودات المكتسبة على نحو غير مشروع في الاقتصاد المشروع.

They urged all States to facilitate the rapid return of assets and to assist requesting States in building capacity to minimize the costs of tracing, confiscating and recovering illegally acquired assets.
وحثّوا جميع الدول على أن تسهّل إعادة تلك الموجودات على وجه السرعة، وأن تساعد الدول الطالبة على بناء القدرات للتقليل ما أمكن من تكاليف تعقّب الموجودات المكتسبة بصورة غير مشروعة ومصادرتها واستردادها.

Each State Party shall provide its competent authorities with sufficient authority, in accordance with principles of its domestic law, to provide assistance to other States Parties in the recovery of illicitly acquired assets and, to that end, shall:
تزوّد كل دولة طرف سلطاتها المختصة، وفقا لمبادئ قانونها الداخلي بصلاحيات كافية، لتقديم المساعدة إلى الدول الأطراف الأخرى على استرداد الموجودات المكتسبة بصورة غير مشروعة، وعليها لتلك الغاية::

3. Following a request made pursuant to this chapter, a State Party in which illicitly acquired assets are situated shall:
3- إثر تلقي طلب مقدم عملا بهذا الفصل، على الدولة الطرف التي توجد فيها الموجودات المكتسبة بصورة غير مشروعة:

1. Illicitly acquired assets recovered pursuant to this chapter shall be disposed of in accordance with domestic law.
1- يُتَصرف في الموجودات المكتسبة بصورة غير مشروعة، والمستردة بمقتضى هذا الفصل، وفقا للقانون الداخلي.

C. Replacement of the phrase " illicitly acquired assets " with the phrase " proceeds of offences established in accordance with this Convention "
الاستعاضة عن عبارة " الموجودات المكتسبة بصورة غير مشروعة " بعبارة " عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية "

(d) Adopt such other measures as it may deem necessary to facilitate the recovery of [illicitly acquired assets].
(د) أن تتخذ ما قد تراه لازما من تدابير لتيسير استرداد [الموجودات المكتسبة بصورة غير مشروعة].

6. The second session of the Conference of the States Parties to the United Nations Convention against Corruption, which Indonesia had hosted, had made a significant contribution to the return of illicitly acquired assets to their countries of origin.
6 - وقال إن الاجتماع الثاني لمؤتمر الدول الأطراف في اتفاقية الأمم المتحدة لمكافحة الفساد الذي استضافته إندونيسيا قدم مساهمة كبيرة لإعادة الموجودات المكتسبة بطريقة غير شرعية إلى بلدان منشأها.

One speaker noted that there was no common denominator in cases of grand corruption where illicitly acquired assets were returned to the countries of origin; he stressed that one of the unique achievements of the Convention was its holistic and integrated approach, addressing, in a single instrument, the prevention of corruption, the freezing of assets, international cooperation and asset recovery.
وأشار أحد المتكلمين إلى عدم وجود قاسم مشترك في حالات فساد فاحش أرجعت فيها الموجودات المكتسبة بصورة غير مشروعة إلى بلدانها الأصلية؛ وشدد على أن أحد المنجزات الفريدة للاتفاقية هو نهجها الشمولي والمتكامل، حيث عولجت في صك واحد قضايا منع الفساد وتجميد الموجودات والتعاون الدولي واسترداد الموجودات.

2. Each State Party shall adopt such measures as may be necessary, in accordance with its domestic law, for financial institutions within its jurisdiction to apply enhanced scrutiny in order to improve the detection of illicitly acquired assets.
2- تعتمد كل دولة طرف ما قد يلزم من تدابير، وفقا لقانونها الداخلي، لكي تجري المؤسسات المالية الواقعة ضمن ولايتها القضائية فحصا مشددا لأجل تعزيز إمكانية كشف الموجودات المكتسبة بصورة غير مشروعة.

States Parties shall also consider taking such measures as may be necessary to permit their competent authorities to share that information with the competent authorities in other States Parties when necessary to investigate, claim and recover illicitly acquired assets.
وعلى الدول الأطراف أيضا أن تنظر في اتخاذ ما قد يلزم من تدابير للسماح لسلطاتها المختصة بتقاسم تلك المعلومات مع السلطات المختصة في الدول الأطراف الأخرى عندما يكون ذلك ضروريا للتحقيق في الموجودات المكتسبة بصورة غير مشروعة والمطالبة بها واستردادها.

(f) Consider adopting such other measures as may be necessary to facilitate the recovery of illicitly acquired assets.
(و) أن تنظر في اتخاذ ما قد يلزم من تدابير أخرى لتيسير استرداد الموجودات المكتسبة بصورة غير مشروعة.()

(d) The illicit acts constitute minor offences or the illicitly acquired assets are of a de minimis value.
(د) اذا كانت الأفعال غير المشروعة تمثل جرائم طفيفة أو كانت الموجودات المكتسبة بصورة غير مشروعة ذات قيمة ضئيلة.
