(a) Demonstrated independence. Judges must uphold and exemplify independence in both its individual and institutional aspects.
(أ) الاستقلال المُثبت - يجب أن يدعم القضاة الاستقلالية وأن يكونوا تجسيدا لها ببعديها الفردي والمؤسسي على حد سواء.

However, as against the guarantor/issuer, confirmer, nominated person or beneficiary other than the grantor, the security right must be exercised in accordance with recommendations 25 bis, 25 ter and 25 quater.

The law should provide that a guarantor/issuer, confirmer or nominated person is not obligated to pay any person other than a confirmer, a nominated person, a named beneficiary, an acknowledged transferee of the independent undertaking or an acknowledged assignee of the proceeds under an independent undertaking.
125- ينبغي أن ينص القانون على أن الكفيل/المُصدر أو المُثبت أو الشخص المسمى ليس ملزما بالسداد لأي شخص غير المُثبت أو الشخص المسمى أو المستفيد المسمى أو المحال إليه المعترف به المستهدف بالتعهّد المستقل أو شخص معترف به تحال إليه العائدات بمقتضى تعهّد مستقل.

The law should provide that, if a secured creditor obtains control by becoming an acknowledged assignee of the proceeds under an independent undertaking, the secured creditor has the right to enforce the acknowledgement against the guarantor/issuer, confirmer or nominated person that made the acknowledgement.
126- ينبغي أن ينص القانون على أنه إذا حصل الدائن المضمون على السيطرة بأن أصبح شخصا معترفا به كمحال إليه فيما يتعلق بتلك العائدات بمقتضى تعهّد مستقل، كان من حقه إنفاذ الاعتراف تجاه الكفيل/المُصدر أو المُثبت أو الشخص المسمّى الذي قام بالاعتراف.

(a) The rights and duties of the guarantor/issuer, confirmer or nominated person that has received a request for an acknowledgement or that has or may pay or otherwise give value under an independent undertaking;
(أ) حقوقَ وواجبات الكفيل/المُصدر أو المُثبت أو الشخص المسمّى الذي تلقى طلبا بالاعتراف أو قام، أو قد يقوم، بالسداد أو بإعطاء قيمة بطريقة أخرى بمقتضى تعهّد مستقل؛

If the applicable law is not specified in the independent undertaking of the guarantor/issuer or confirmer, the law governing the matters referred to in recommendation 208 is the law of the State of the location of the branch or office of the guarantor/issuer or confirmer indicated in the independent undertaking.
209- إذا لم يحدَّد القانون الواجب التطبيق في التعهّد المستقل الصادر عن الكفيل/المُصدر أو المثبت، كان القانونُ الذي يحكم المسائل المشار إليها في التوصية 208 هو قانونَ الدولة التي يقع فيها فرع الكفيل/المُصدر أو المُثبت أو مكتبه المذكور في التعهّد المستقل.

However, enforcement does not permit the secured creditor to demand payment from the guarantor/issuer, confirmer or nominated person (see recommendation 27).
غير أن الإنفاذ لا يسمح للدائن المضمون بأن يطالب بالسداد من الكفيل/المُصدر أو المُثبت أو الشخص المسمّى (انظر التوصية 27).

(b) Demonstrated impartiality. Judges must be (and must be seen to be) impartial in the process by which their decisions are made, as well as in the substance of their decisions.
(ب) الحياد المُثبت - يجب أن يلتزم القضاة الحياد (وأن يجسدوه في سلوكهم) خلال إجراءات صنع القرار وفي جوهر قراراتهم كذلك.

(d) Demonstrated commitment to equal treatment. Judges must treat all who appear before them in court, whether as parties, advocates, witnesses or officials, on the basis of equality, so as to ensure the actuality and appearance of a fair outcome in matters before them.
(د) الالتزام المُثبت بالمساواة في المعاملة - يلتزم القضاة بالمساواة في المعاملة بين جميع من يَمثُل أمامهم في المحكمة، سواء كأطراف أو محامين أو شهود أو مسؤولين، توخيا للتوصل إلى نتيجة عادلة من حيث الجوهر والمظهر في المسائل المعروضة عليهم.
