If the wastes in question are required as a raw material for recycling or recovery industries in the country of import; or,

If the country of export does not have the technical capacity and the necessary facilities to dispose of the wastes in question in an environmentally sound and efficient manner; or

9. The Parties shall require that each person who takes charge of a transboundary movement of hazardous wastes or other wastes sign the movement document either upon delivery or receipt of the wastes in question.
9 - على الأطراف أن تشترط أن يقوم كل شخص مسؤول عن نقل نفايات خطرة أو نفايات أخرى عبر الحدود بالتوقيع على وثيقة النقل إما عند تسليم النفايات قيد النظر أو استلامها.

2. In case of a transboundary movement of hazardous wastes or other wastes deemed to be illegal traffic as the result of conduct on the part of the exporter or generator, the State of export shall ensure that the wastes in question are:

In the case of a transboundary movement deemed to be illegal traffic as the result of conduct on the part of the importer or disposer, the State of import is to ensure that the wastes in question are disposed of in an environmentally sound manner by the importer or disposer or, if necessary, by itself.
وفي الحالة التي تعتبر فيها حركة نفايات خطرة ونفايات أخرى عبر الحدود اتجاراً غير مشروع لكونها نتيجة تصرف قام بها المستورد أو المتخلص، تضمن دولة الاستيراد أن يتولى المستورد أو المتخلص، أو هي ذاتها عند اللزوم، التخلص من النفايات قيد النظر بطريقة سليمة بيئياً.

In the case of illegal traffic (as defined in article 9, paragraph 1), the country of export shall ensure that the wastes in question are taken back into the country of export for their disposal or disposed of in accordance with the provisions of the Basel Convention.
في حالة الاتجار غير المشروع (كما ورد في المادة 9، الفقرة1)، يضمن البلد التصدير عودة النفايات قيد النظر إلى بلد التصدير للتخلص منها أو يتم التخلص منها وفقاً لأحكام اتفاقية بازل.

(ز) صنع استيراد النفايات الخطرة والنفايات الأخرى إذا كان لديه سبب يحمله على الاعتقاد بأن النفايات قيد النظر لن تدار بطريقة سليمة بيئياً؛

(g) Prevent the import of hazardous wastes and other wastes if it has reason to believe that the wastes in question will not be managed in an environmentally sound manner.

Article 8 provides that, in such cases, " the State of export shall ensure that the wastes in question are taken back into the State of export, by the exporter, if alternative arrangements cannot be made for their disposal in an environmentally sound manner, within 90 days from the time that the importing States informed the State of export and the Secretariat, or such other period of time as the States concerned agree " .
وتنص المادة ٨ على أنه، في هذه الحالات، " تضمن دولة التصدير قيام المصدر بإعادة النفايات قيد النظر الى دولة التصدير إذا تعذر وضع ترتيبات بديلة للتخلص منها بطريقة سليمة بيئيا خلال ٠٩ يوماً من تاريخ قيام دولة الاستيراد بابلاغ دولة التصدير واﻷمانة، أو خلال فترة زمنية أخرى تتفق عليها الدول المعنية " .

Similarly, subparagraph 2 (g) of article 4 further requires that a State " [p]revent the import of hazardous wastes and other wastes if it has reason to believe that the wastes in question will not be managed in an environmentally sound manner " .
