The Constitution of Kenya, 2010, provides that any treaty or convention ratified by Kenya shall form part of the law of Kenya and that general rules of international law shall form part of the law of Kenya under the Constitution therefore once ratified International Instruments can be directly applied by the courts, tribunals or administrative authorities in the absence of domestic legislation on the same.

The Committee, while noting that according to article 7 of the new Constitution the State party shall observe the international human rights treaties, remains concerned at the fact that the Covenant has not yet been fully incorporated into domestic law and that the Covenant rights have not been invoked before, or directly enforced by, domestic courts, tribunals or administrative authorities.
