The Council of the Government for National and Ethnic Minorities had reviewed the current periodical reports on the implementation of these two conventions without requesting any additional measures.

12. While taking note of the draft law on National and Ethnic Minorities and on regional languages, the HR Committee in 2004 was concerned that current legislation does not allow linguistic minorities to use their own languages when dealing with administrative authorities in areas where their numbers warrant this.
12- وفي عام 2004، أحاطت اللجنة المعنية بحقوق الإنسان علماً بمشروع القانون الخاص بالأقليات القومية والإثنية واللغات الإقليمية، وأعربت عن قلقها لعدم سماح القانون الحالي للأقليات اللغوية باستعمال لغتها عند التعامل مع السلطات الإدارية في مجالات تبرر أعدادها استعمال هذه اللغات.

502. The Committee further suggests that recommendations regarding suitable measures in the field of segregated education as proposed by the Parliamentary Commissioners on Civil Rights and the Parliamentary Commissioner for National and Ethnic Minorities Rights be given due consideration.
502- كما تقترح اللجنة بأن يولى الاعتبار الواجب للتوصيات المتعلقة بالتدابير المناسبة في مجال العزل في التعليم التي اقترحتها اللجنة البرلمانية المعنية بالحقوق المدنية واللجنة البرلمانية المعنية بالأقليات القومية والإثنية.

(a) The enactment, in January 2005, of the Law on National and Ethnic Minorities and Regional Language aimed at the protection of minority languages;

Despite the efforts of the State party in promoting the rights of persons belonging to minorities, including implementation of the Act on National and Ethnic Minorities and Regional Languages, the Committee is concerned about ongoing negative stereotypes of National and Ethnic Minorities.

53. According to the written replies to the list of issues, auxiliary languages were used to communicate with the authorities in only 18 of the 30 communes listed in the official register established under the Law on National and Ethnic Minorities.

47. Ms. Glowacka-Mazur (Poland) said that the Law on National and Ethnic Minorities provided for the right to use a minority language as an auxiliary language in dealing with the authorities, orally and in writing, in communes where the number of inhabitants belonging to a minority represented at least 20 per cent of the population and which were registered on that account in the official register of communes using an auxiliary language.
47- السيدة غلوفاكا - مازور (بولندا) قالت إن القانون المتعلق بالأقليات القومية والإثنية ينص على الحق في استعمال إحدى لغات الأقليات كلغة مساعدة في التعامل، شفوياً وخطياً، مع السلطات في البلديات التي يشكل عدد قاطنيها ممن ينتمون إلى أقلية 20 في المائة على الأقل من السكان والمسجلة بهذه الصفة في السجل الرسمي للبلديات التي تستعمل لغة مساعدة.

However, positive rights (art. 25) - the right to develop their own culture, the right to receive information in their native language and associate in national associations and the right to education in their own language, their right to use their language when dealing with officials and the right to participate in the resolution of matters concerning National and Ethnic Minorities - apply only to citizens of the Czech Republic.
غير أن الحقوق الوضعية (المادة 25) لهذه الأقليات - الحق في تنمية ثقافتها الخاصة، والحق في تلقي المعلومات بلغتها الأصلية والانضمام إلى اتحادات وطنية والحق في التعليم بلغتها الأصلية، وحقها في استخدام لغتها عندما تتعامل مع المسؤولين والحق في المشاركة في حل المسائل المتصلة بالأقليات القومية والإثنية - فلا تنطبق إلا على مواطني الجمهورية التشيكية.
