98. The Committee notes that Canada has made a declaration with regard to the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict upon ratification, permitting voluntary recruitment into the armed forces at the age of 16 years.
98- تلاحظ اللجنة أن كندا أصدرت إعلاناً بشأن البروتوكول الاختياري الملحق باتفاقية حقوق الطفل والمتعلق بإشراك الأطفال في النزاعات المسلحة ، وقت التصديق عليه، تسمح بموجبه بالتجنيد الطوعي في سن السادسة عشرة.

With respect to voluntary recruitment, a State Party would agree to deposit a binding declaration which would set forth the minimum age that it would apply with respect to (a) voluntary recruitment of persons into its national armed forces and (b) the participation of such persons in armed conflict.

She further recalled that her recommendations to the working group (E/CN.4/2000/WG.13/3) provided for the setting of a minimum age of 18 years for participation in hostilities and for all forms of recruitment, with an opt-out provision regarding voluntary recruitment allowing for a minimum age of 17 years with reference to national legislation.
18- وذكرت كذلك أن توصياتها إلى الفريق العامل (E/CN.4/2000/WG.13/3) قد نصت على وضع حد أدنى لسن الاشتراك في الأعمال القتالية ولجميع أشكال التجنيد، هو 18 سنة، مع نص فيما يتعلق بالتجنيد الطوعي يتضمن السماح بحد أدنى قدره 17 سنة بالإشارة إلى التشريعات الوطنية.

(c) In the event that the optional protocol included an exception to the rule covering voluntary recruitment for purposes of education and vocational training in establishments operated by or under the control of the armed forces, particular attention should be paid to the implementation of that exception, in order to prevent it from allowing any circumvention of the principle of the established age limit of 18 years;
