In the latter scenario, assuming that the State could provisionally apply a treaty that had not entered into force for that State despite entering into force internationally, the question arose what the international legal consequences were, if any, for a State if it failed to discharge the treaty obligations that it provisionally applied.

Each High Contracting Party to the Protocol shall submit an initial declaration on the implementation of the provisions of the Protocol to the Depository of the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May be Deemed to be Excessively Injurious or to Have Indiscriminate Effects, no later than 60 days after the entry into force of this Protocol for that State Party.
1- يقدم كل طرف متعاقد سامٍ في البروتوكول إعلاناً أولياً عن تنفيذ أحكام البروتوكول إلى الجهة الوديعة لاتفاقية حظر أو تقييد استعمال أسلحة تقليدية معينة يمكن اعتبارها مفرطة الضرر أو عشوائية الأثر، وذلك في موعد لا يتجاوز 60 يوماً من بدء نفاذ هذا البروتوكول بالنسبة إلى تلك الدولة الطرف.

1. Pursuant to article 5.1, each State Party " undertakes to destroy or ensure the destruction of all anti-personnel mines in mined areas under its jurisdiction or control, as soon as possible but not later than ten years after the entry into force of this Convention for that State Party " .
1- عملاً بالمادة 5-1، تتعهد كل دولة طرف " بتدمير أو ضمان تدمير كل الألغام المضادة للأفراد في المناطق الملغومة المشمولة بولايتها أو الخاضعة لسيطرتها، في أقرب وقت ممكن، على ألا يتعدى ذلك عشر سنوات من بدء نفاذ الاتفاقية بالنسبة إلى تلك الدولة الطرف " .

4. Article 5 of the Convention requires each State Party to ensure the destruction of all anti-personnel mines in mined areas under its jurisdiction or control as soon as possible but not later than 10 years after the entry into force of the Convention for that State Party. 2004 is the midpoint between the Convention's entry into force and the first mine-clearance deadlines.

Action #26 Within one year of the Convention entering into force for that State, review national laws and policies, with a view to meeting the needs and protecting the human rights of cluster munition victims, ensuring that national legal and policy frameworks do not discriminate against or among cluster munition victims and those who have suffered injuries or disabilities from other causes.

Action #13 Endeavour to, within one year of entry into force for that State Party, systematically use contamination and prioritisation information to develop and begin implementing a national clearance plan, which includes transparent and consistent criteria for clearance priorities, promotes risk reduction education, and builds, where appropriate, upon existing structures, experiences, related plans and methodologies.

In the absence of such mechanisms, establish such a coordination mechanism actively involving cluster munition victims and their representative organizations as well as relevant health, rehabilitation, social services, education, employment, gender and disability rights experts within one year of the Convention's entry into force for that State Party.
وفي حال عدم وجود مثل هذه الآليات، إنشاء آلية تنسيق تُشرك إشراكاً نشطاً ضحايا الذخائر العنقودية والمنظمات التي تمثلهم فضلاً عن الخبراء المناسبين في مجالات حقوق الصحة وإعادة التأهيل والخدمات الاجتماعية والتعليم والعمل والمساواة بين الجنسين والإعاقة، وذلك في غضون فترة لا تتجاوز سنة واحدة من بدء نفاذ الاتفاقية بالنسبة إلى تلك الدولة الطرف.

Action #33 Endeavour to, within one year after entry into force for that State party, develop or update comprehensive national plans for meeting all obligations concerning stockpile destruction, clearance and victim assistance, identify resources currently available to meet these obligations and identify needs for international cooperation and assistance.
الإجراء رقم 33 القيام، في غضون فترة لا تتجاوز سنة واحدة من بدء نفاذ الاتفاقية بالنسبة إلى تلك الدولة الطرف، بوضع خطط وطنية شاملة أو تحديث ما هو موجود منها للوفاء بجميع الالتزامات في مجال تدمير المخزونات والتطهير ومساعدة الضحايا، وتحديد الموارد المتاحة حالياً للوفاء بهذه الالتزامات، وتحديد الاحتياجات من التعاون والمساعدة الدوليين.
