The Council of Europe Guidelines on human rights and the fight against terrorism refer to the " imperative duty of States to protect their populations against possible terrorist acts, " (Preamble, para. f) while the Inter-American Commission on Human Rights emphasizes that " the State has the right and duty to guarantee the security of all. "

In July 2002, the Committee of Ministers of the Council of Europe adopted the Guidelines on human rights and the fight against terrorism. Guideline No. XIII, paragraph 2, provides that extradition of a person to a country where he/she risks being sentenced to the death penalty may not be granted, unless the guarantees mentioned above are given.

The Council of Europe provided the text of the Guidelines on human rights and the fight against Terrorism, adopted on 11 July 2002, as well as the final activity report of the Group of Specialists on human rights and the fight against Terrorism containing, inter alia, the reference texts used in the preparation of the guidelines.4

The efforts to strengthen legal action against terrorism are based on the fundamental principle that it is possible and necessary to fight terrorism while respecting human rights, fundamental freedoms and the rule of law, in the spirit of the Guidelines on human rights and the fight against Terrorism adopted by the Committee of Ministers of the Council of Europe on 15 July 2002.
