260- وقد خلص الفريق في تقاريره السابقة إلى أن الخسارة المترتبة على عدم الاستفادة من الأموال المودعة في المصارف العراقية لا تعدّ خسارة مباشرة ما لم تتمكن الجهة المُطالبة من إثبات أن العراق كان ملزماً بموجب عقد أو التزام آخر محددين بصرف هذه الأموال بعملات قابلة للتحويل وبالإذن بتحويلها إلى خارج العراق وبأن قيام العراق بغزو واحتلال الكويت قد حال دون حدوث عملية الصرف والتحويل هذه.
