٦٢- تنص المادة ٥ من القانون على أن للوزير صلاحية في أن يعتبر من ولد خارج العراق من عراقية وأب مجهول أو لا جنسية له عراقي الجنسية إذا اختارها خلال سنة من تاريخ بلوغه سن الرشد.

وقد نصت المادة 164 من قانون الأحوال الشخصية على أنه: " ليس للقاصر أن يتسلم أمواله قبل بلوغه سن الرشد " .

Article 4: The Minister may consider to be an Iraqi national any person born outside Iraq to an Iraqi mother and an unknown or stateless father, if he chooses Iraqi nationality within one year from reaching the age of majority, unless circumstances prevent him from doing so, provided he is resident in Iraq at the time of applying for Iraqi nationality.
المادة (4): للوزير أن يعد من ولد خارج العراق من أم عراقية وأب مجهول ولا جنسية له عراقي الجنسية إذا أختارها خلال سنة من تاريخ بلوغه سن الرشد إلا إذا حالت الظروف الصعبة دون ذلك بشرط أن يكون مقيما في العراق وقت تقديمه طلب الحصول على الجنسية العراقية.

In order for such transactions to be valid, the approval of the parents is required if the transactions are so significant as to have a vital influence on the minor's life, or if they are such that they might also affect the minor's life after reaching majority.
ولكي تكون تلك الصفقات صحيحة، لا بد من موافقة الوالدين إذا كانت تلك الصفقات من الأهمية بحيث يكون لها تأثير حيوي في حياة القاصر، أو إذا كانت بحيث يمكن أن تؤثر في حياة القاصر بعد بلوغه سن الرشد.

Since the Children's Rights Amendment Act entered into force, a minor, who entered into a legal transaction without the consent of his/her legal representative, is obliged to bear the legal consequences of this legal transaction upon reaching majority only in those cases when he/she acknowledges in writing the assumption of this (earlier) commitment.
299- ومنذ دخول القانون المعدل لحقوق الطفل حيز النفاذ، لا يُفرض على القاصر الذي يدخل في صفقة قانونية دون موافقة ولي أمره تحمل العواقب القانونية لهذه المعاملة القانونية عند بلوغه سن الرشد إلا في الحالات التي يعترف فيها خطياً بعقد هذا الالتزام (السابق).

Article 4 provides that the Minister may consider anyone born outside Iraq to an Iraqi mother and an unknown or stateless father to be an Iraqi national if he or she chooses Iraqi nationality within one year of the date of attainment of majority, unless prevented from doing so by difficult circumstances and provided that he or she is resident in Iraq at the time of submitting the application for Iraqi nationality.
وجاء في المادة (4) أن للوزير أن يعتبر من ولد خارج العراق من أم عراقية وأب مجهول أو لا جنسية له عراقي الجنسية إذا اختارها خلال سنة من تاريخ بلوغه سن الرشد إلا إذا حالت الظروف الصعبة دون ذلك بشرط أن يكون مقيماً في العراق وقت تقديمه طلب الحصول على الجنسية العراقية.

Where the child's parents are married to each other, the question of its citizenship may, in the absence of a joint declaration by the parents, be decided by a court of law upon application by one of the parents, the person appointed to act as the child's tutor or guardian, or by the child itself upon coming of age (art. 53).
وإذا وُلد الطفل في إطار الزواج يجوز أن تقرر المحكمة جنسيته، في حالة عدم وجود إعلان مشترك من الوالدين، بناء على طلب من أحد الوالدين أو الشخص المعيﱠن كوصي أو ولي اﻷمر، أو أن يقررها الطفل نفسه عند بلوغه سن الرشد )المادة ٣٥(.

7. Mr. Ould Baidy (Mauritania) said that under the Mauritanian Nationality Code the nationality of a child of a Mauritanian mother and foreign father had to be decided one year before the child reached majority.
