Pursuant to rule 108, paragraph 9, of the Committee's rules of procedure, the State party was requested not to expel the author to the Islamic Republic of Iran pending the consideration of his case by the Committee.

5.3 The State party notes that the decision for the author's removal to his country of origin was taken in accordance with articles 16, 88 (para. 1), and 117 of the Law on Movement and Stay of Aliens and Asylum, which provide that once an application for international protection is rejected by way of a final legally binding decision, the person shall be expelled from the country.
