9 - عُدلت القاعدة 204/3، أنواع التعيين وإعادة التوظيف، لتحديد مستحقات موظف المشاريع التي تخضع للتسوية عند منحه تعيينا جديدا في النظام الموحد للأمم المتحدة في غضون فترة تقل عن اثني عشر شهرا من تاريخ انتهاء خدمته؛ ولتوضيح المنهجية التي تطبق في هذا الغرض.

(a) A former staff member who is re-employed shall be given a new appointment unless he or she is reinstated under staff rule 4.18 below.
(أ) الموظف السابق الذي يعاد توظيفه يُمنح تعيينا جديدا أو يُرد إلى وضعه السابق وفقا لأحكام القاعدة 4/18 أدناه.

However, where a staff member of the United Nations common system is granted a new appointment within twelve months of separation, any entitlement, benefit or accrual the staff member may have when separated for a second time should be adjusted in such a way that the total payments for the first and second separation do not exceed the amounts which would have been paid had the service been continuous.
إلا أنه في حالة منح الموظف في النظام الموحد لﻷمم المتحدة تعيينا جديدا في غضون ١٢ شهرا من تاريخ انتهاء خدمته، ينبغي تسوية ما قد يكون للموظف لدى انتهاء خدمته مرة ثانية من استحقاقات أو مستحقات أو أرصدة متجمعة بحيث لا يتجاوز مجموع المدفوعات عن انتهاء الخدمة في المرتين اﻷولى والثانية المبالغ التي كانت ستدفع له لو أن الخدمة كانت مستمرة؛

With the caveat that the Parties are the ultimate authority on the interpretation of decisions of the meetings of the Parties, the Secretariat also notes, however, that the operative text of decisions Ex.1/4 and XVI/6 does not appear to require Switzerland to submit its accounting framework for the critical use exemptions it was granted in 2005 until and unless the Party submits a new nomination for exemption.

(b) Former project personnel who are re-employed shall be given a new appointment, the terms of which shall be fully applicable without regard to any period of former service.
