In a claim by the assignee against the debtor for payment of the assigned receivable, the debtor may raise against the assignee all defences and rights of set-off arising from the original contract, or any other contract that was part of the same transaction, of which the debtor could avail itself as if the assignment had not been made and such claim were made by the assignor.
1 - عندما يطالب المحال إليه المدين بسداد المستحق المحال، يجوز للمدين أن يتمسك تجاه المحال إليه بكل ما ينشأ عن العقد الأصلي، أو أي عقد آخر يشكل جزءا من المعاملة ذاتها، من دفوع وحقوق مقاصة كان يمكن للمدين أن يتمسك بها وكأن تلك الإحالة لم تُجر وكانت تلك المطالبة صادرة عن المحيل.

Where a claim has been found to be compensable in this instalment and compensation for the same loss has been awarded in another claim, the amount of compensation awarded in the other claim has been deducted from the compensation calculated for the claim in this instalment.

The Special Rapporteur explained that the failure of a State to protest a claim or a situation did not necessarily connote any intention on its part to create legal effects, specifically, to render that claim or situation opposable to itself.

What was relevant was that the State bringing such a claim espoused the cause of its nationals and stated as much.
وما هو وثيق الصلة بالموضوع هو أن الدولة التي تقدم تلك المطالبة تتبنى قضية مواطنيها وتصرح بذلك.

In particular, it was indicated that according to some, such a demand would always amount to a variation of the contract of carriage and would therefore require the parties' agreement.
