States would be reluctant to accept the problematic concept of State crimes, their main concern being that the criminalization of a State could result in the punishment of an entire people, with adverse consequences.

Still, according to a third view supported by some other delegations, the notion of State crimes should be deleted for it was controversial, confusing, vague, problematic, impractical and unhelpful.

The controversial concept of " State crimes " should be eliminated from the discussion of State responsibility because it had not gained the broad international acceptance required for a new concept with such wide-ranging consequences.
ويجب استبعاد مفهوم " جنايات الدولة " الخلافي من مناقشة موضوع مسؤولية الدول ﻷنه لم يحظ بالقبول الدولي العام الذي يحتاج إليه مفهوم جديد تترتب عليه نتائج واسعة النطاق جدا.

He noted in this connection that when State crimes were committed, the injured party was the international community as a whole, so that restitution must not be subject to more limitations than those necessary to preserve the existence of the wrongdoing State and meet the vital needs of the population.
