1. On 4 March 2005, the International Criminal Tribunal for the Former Yugoslavia, Office of the Prosecutor, indicted the members of the so-called Kosovo Liberation Army (KLA) Ramush Haradinaj, Idriz Balaj and Lahi Brahimaj.
1 - في 4 آذار/مارس 2005، وجه مكتب المدعي العام للمحكمة الجنائية الدولية ليوغوسلافيا السابقة لائحة اتهام إلى أعضاء ما يُسمى جيش تحرير كوسوفو راموش هاراديناي وادريس بالاي ولاهي براهيماي.

More precisely, the accused Ramush Haradinaj and Idriz Balaj were found not guilty in regard to 31 counts of the initial indictment in the Appeals judgment and they will not stand trial for the crimes listed in these counts ever again.

Ramush Haradinaj and Lahi Brahimaj surrendered to the Tribunal on 9 March.

The Office of the Prosecutor continues to rely on cooperation from the United Nations Interim Administration Mission in Kosovo (UNMIK), in particular related to the case against Ramush Haradinaj et al. As previously reported, there are serious problems related to the protection of witnesses in that case.

1. The political institutions of Kosovo demonstrated deepening maturity by electing a new Government quickly after the resignation of the former Prime Minister, Ramush Haradinaj.

On 4 March, the indictment against Ramush Haradinaj, a former senior commander in the Kosovo Liberation Army (KLA), Idriz Balaj, a former commander of a special unit within the KLA, and Lahi Brahimaj, a former deputy commander in the KLA, was confirmed.

The Office of the Prosecutor did not, for reasons that are unknown, indict Ramush Haradinaj, Idriz Balaj and Lahi Brahimaj on the basis of command responsibility, regardless of the fact that the majority of the crimes for which they were indicted were perpetrated precisely at the commanding place of the so-called KLA in Jablanica.

5. On 3 April 2008, the Trial Chamber rendered its judgment: because of the lack of evidence, Ramush Haradinaj and Idriz Balaj were found not guilty on all counts of the indictment, while Lahi Brahimaj was sentenced to six years' imprisonment.
5 - وفي 3 نيسان/أبريل 2008، أصدرت الدائرة الابتدائية حكمها وهو كالتالي: نظراً لعدم وجود أدلة، تمت تبرئة راموش هاراديناي وإدريس بالاي من جميع التهم الموجهة إليهما، في حين حكم على لاهي براهيماي بالسجن مدة ست سنوات.

20. The case of Prosecutor v. Ramush Haradinaj et al. is at the pretrial phase after the Appeals Chamber ordered a partial retrial on 21 July 2010.
