This would mean that service of process is to be completed without any procedure undertaken by a court, etc., which is usually the case in a service of process instituting a proceeding against a private person.

1. Service of process by writ or other document instituting a proceeding against a State shall be effected:
1 - يتم تبليغ صحيفة الدعوى بورقة قضائية أو بوثيقة أخرى تقام بموجبها دعوى ضـد دولة مـا:

The Court agreed with the claimant that the reference to the arbitration agreement in the statement of claim and the absence of the respondent's counterargument can indeed be considered an arbitration agreement.

4 - لا يجوز لأي دولة تحضر للدفاع في الموضوع في دعوى مقامة ضدها أن تتمسك بعد ذلك بأنه لم تراع في تبليغ صحيفة الدعوى أحكام الفقرتين 1 و 2.

Rather this enables the claimant to present the statement of claim and the respondent's reply to it in their originals or duly certified copies, which would be treated as an arbitration agreement by the Court.
