The international cooperation efforts of the Government of Mexico to assist in obtaining evidence and fulfilling procedures in criminal cases, including letters rogatory, is based on two systems or channels for routing and receiving requests:
إن جهود التعاون التي تبذلها حكومة المكسيك دوليا للمساعدة في الحصول على الأدلة واتخاذ الإجراءات في القضايا الجنائية، بما فيها الإخطارات بالإنابة القضائية، تقوم على نظامين أو قناتين لإرسال الطلبات وتلقيها، وذلك على النحو التالي:

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences under this Convention may be transferred if the following conditions are met:
1 - يجوز نقل الشخص المحتجز في إقليم دولة طرف، أو الذي يقضي مدة حكمه في إقليمها، والمطلوب وجوده في دولة أخرى من الدول الأطراف لأغراض تحديد الهوية أو الشهادة أو المساعدة بأي شكل آخر في الحصول على الأدلة اللازمة للتحقيق في الجرائم أو المحاكمة عليها بموجب هذه الاتفاقية، إذا استُوفي الشرطان التاليان:

These encompassed inadequate legislation which did not yet criminalize the broad range of preparatory acts related to the flow of foreign terrorist fighters, and challenges in bringing foreign terrorist fighters to justice, including difficulties in obtaining evidence from other countries.

In addition, difficulties in obtaining evidence from other States could impede prosecution in national courts, and many States' domestic legal systems lacked the capacity to investigate and prosecute extraterritorial criminal cases.

42. In addition, the Evidence (Proceedings in foreign tribunals) Act (Act No. 32 of 1991) allows the High Court to assist in obtaining evidence requested for the purposes of proceedings in foreign tribunals.

The Security Council, in its resolution 1373 (2001), decided that all States should afford one another the greatest measure of assistance in connection with criminal investigations or criminal proceedings relating to the financing or support of terrorist acts, including assistance in obtaining evidence in their possession necessary for the proceedings.

(c) States are encouraged to consider affording one another possible measures of assistance in connection with investigations and criminal or extradition proceedings in respect of crimes of a serious nature committed by United Nations officials and experts on mission, including assistance in obtaining evidence at their disposal that is necessary for the conduct of the proceedings.

The Committee also recalls that the burden of proof cannot rest alone on the author of the communication, especially considering that the author and the State party do not always have equal access to evidence and that frequently the State party alone has access to relevant information.
وتُذكِّر اللجنة أيضاً بأن عبء الإثبات لا يقع على صاحب البلاغ حصرياً، ذلك أن صاحب البلاغ والدولة الطرف لا يتمتعان دائماً بنفس الحق في الحصول على الأدلة وأن الدولة الطرف كثيراً ما تكون الطرف الوحيد الذي يملك الاطلاع على المعلومات الضرورية.

Violation of the right to evidence should, furthermore, be considered relevant, that is, there must be a correlation between the fact that is intended to be established and the proof that it did not take place, and that the facts are of a nature that, had they taken place, the outcome of the trial might be different.
