9.1 On 2 March 2007 the State party repeated that no provision of the Convention had been violated and expressed surprise that the Committee should have found the complaint admissible.

6.2 The Committee notes that the State party objects to the admissibility of the complaint on the grounds of failure to exhaust civil domestic remedies.

4.4 Moreover, the registrar of the Court, in his letter of 14 April 1999, informed the author that if he wished a judge to decide on the question of admissibility of the complaint, he should so inform the Court.

10.3 With respect to the complainant's claim under article 3, paragraph 1, of the Convention, the Committee finds that no further obstacles to the admissibility of the complaint exist.
10-3 وفيما يتعلق بإدعاء صاحب الشكوى بموجب الفقرة 1 من المادة 3 من الاتفاقية، ترى اللجنة عدم وجود أي عقبات أخرى تحول دون قبول الشكوى.

5.1 On 17 May and 8 June 2010 the complainant noted that domestic remedies have been exhausted and that there is therefore no obstacle to the admissibility of the complaint.
5-1 يشير صاحب الشكوى إلى أن سبل الانتصاف المحلية قد استُنفدت، في 17 أيار مايو و8 حزيران/يونيه 2010، وإلى أنه لا يوجد بالتالي أي عائق يحول دون إمكانية قبول الشكوى.

4.9 The State party submits that it is the responsibility of the complainant to establish a prima facie case for the purpose of admissibility of the complaint under article 22 of the Convention. In the present complaint, it has not been established that there are substantial grounds for believing that the complainant would be in danger of being subjected to torture if returned to Sri Lanka.
4-9 وتدفع الدولة الطرف بأن صاحبة الشكوى مسؤولة عن إثبات وجاهة قضيتها بوضوح من أجل قبول الشكوى بموجب المادة 22 من الاتفاقية، ولم يثبت في هذه الشكوى وجود أسباب قوية تحمل على الاعتقاد بأن صاحبة الشكوى ستتعرض للتعذيب في حال إعادتها إلى سري لانكا.

Consequently, the Committee finds that there is no obstacle to the admissibility of the complaint in accordance with article 22, paragraph 5 (a), of the Convention.
وعليه، ترى اللجنة أنه لا يوجد أي عائق يحول دون قبول الشكوى بموجب الفقرة الفرعية (أ) من الفقرة 5 من المادة 22 من الاتفاقية().

Given the circumstances and the absence of observations from the State party querying the lack of exhaustion of domestic remedies, the Committee finds that there is no obstacle to the admissibility of the complaint in accordance with article 22, paragraph 5 (b), of the Convention.
وفي ظل هذه الظروف، ونظراً لعدم إبداء الدولة الطرف ملاحظات تشكّك في تمام استنفاد سبل الانتصاف المحلية، ترى اللجنة أنه لا يوجد أي عائق يحول دون قبول الشكوى بموجب الفقرة الفرعية (ب) من الفقرة 5 من المادة 22 من الاتفاقية.

4.2 On 28 December 1992, the communication was transmitted to the State party under rule 91 of the rules of procedure, requesting it to provide information and observations on the question of admissibility.
