8. The following were the conditions of service and allowances proposed by the Secretary-General for the judges of the International Tribunal for the Former Yugoslavia:

In this connection, the Committee recommends that the conditions of service and allowances which would be approved for the judges of the International Tribunal for the former Yugoslavia be extended to the judges of the International Tribunal for Rwanda.

5. The pension scheme for judges of the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, under the current arrangements, is similarly non-contributory.

28. In section VIII, paragraph 6, of its resolution 53/214, the Assembly approved pension scheme regulations for the judges of the International Tribunal for the Former Yugoslavia and of the International Criminal Tribunal for Rwanda.

13. Postponement of the first election of the members of the Commission was not the first such action undertaken by the Meeting: the first election of the judges of the International Tribunal for the Law of the Sea was postponed by the Meeting for over 14 months.

On 4 October 2007 the Registrar of the International Tribunal for the Former Yugoslavia addressed a letter to the Secretary-General on the pensions of the judges of the International Tribunal (see annex).
في 4 تشرين الأول/أكتوبر 2007، وجه مسجل المحكمة الدولية ليوغوسلافيا السابقة رسالة إلى الأمين العام تتعلق بالمعاشات التقاعدية لقضاة المحكمة الدولية (انظر المرفق).

10. With regard to the pension benefits of the judges of the Tribunals, it has been recalled that the General Assembly, in section VIII, paragraph 6, of its resolution 53/214, approved the pension scheme regulations for the judges of the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, respectively.
10 - فيما يتعلق بالمعاشات التقاعدية لقضاة المحكمتين، أشير إلى أن الجمعية العامة أقرّت، في الفقرة 6 من الجزء ثامنا من قرارها 53/214، توصيات اللجنة الاستشارية بشأن النظام الأساسي للمعاشات التقاعدية لقضاة المحكمة الدولية ليوغوسلافيا السابقة وقضاة المحكمة الجنائية الدولية لرواندا على التوالي.

(a) The pension scheme for the judges of the International Tribunal for the Former Yugoslavia and the judges of the International Criminal Tribunal for Rwanda should, respectively, remain a defined-benefit scheme;
(أ) أن يظل نظام المعاشات لقضاة المحكمة الدولية ليوغوسلافيا السابقة وقضاة المحكمة الجنائية الدولية لرواندا هو نظام استحقاق محدد؛

In addition, it observed that while the General Assembly had decided to apply to the judges of the International Court of Justice the methodology used by ICSC for United Nations staff members, the Meeting of States Parties had not taken such a decision for judges of the Tribunal as States parties were not in a position to make informed decisions on the applicability of that methodology to the Tribunal.
وبالإضافة إلى ذلك، ذكر الوفد أنه بينما قررت الجمعية العامة أن تطبق على قضاة محكمة العدل الدولية المنهجية التي تتبعها لجنة الخدمة المدنية الدولية فيما يخص موظفي الأمم المتحدة، فإن اجتماع الدول الأطراف لم يتخذ مقررا مماثلا بالنسبة لقضاة المحكمة الدولية لقانون البحار لأنه لم يكن في مقدور الدول الأطراف أن تتخذ قرارات مستنيرة بشأن إمكانية تطبيق هذه المنهجية على المحكمة.

It also supported the principle of equity in benefits for the judges of the International Court and the Tribunals.
