There were a few outstanding issues requiring clarification in section B, dealing with other serious violations of the laws and customs applicable in international armed conflict.

With regard to the specification of the crimes, some delegations felt that the reference to serious violations of the laws and customs applicable in armed conflict was not sufficiently precise for the purposes of the principle of legality.

There was general agreement that serious violations of the laws and customs applicable in armed conflict could qualify for inclusion under the jurisdictional standard referred to in the second paragraph of the preamble.

34. There was general agreement that serious violations of the laws and customs applicable in armed conflict could qualify for inclusion under the jurisdictional standard referred to in the second paragraph of the preamble.

Regarding subparagraph (c) of article 20, many delegations agreed that serious violations of the laws and customs applicable in armed conflict met the criteria for inclusion in the jurisdiction of the court set forth in the preamble.
٧٢ - بالنسبة للفقرة الفرعية )ج( من المادة ٢٠، اتفقت عدة وفود على أن الانتهاكات الجسيمة للقوانين واﻷعراف التي تسري على المنازعات المسلحة تنطبق عليها معايير اﻹدراج في اختصاص المحكمة المحددة في الديباجة.

This may be so, but, as regards " aggression " , " serious violations of the laws and customs applicable in armed conflict " or " crimes against humanity " , there is no international written law, other than the draft statute, which defines these crimes as crimes for which individuals may be held criminally responsible and for which they may be prosecuted.
ولقد يكون اﻷمر كذلك، إلا أنه فيما يتعلق بجرائم " العدوان " و " الانتهاكات الجسيمة للقوانين واﻷعراف التي تسري على المنازعات المسلحة " أو " الجرائم ضد اﻹنسانية " ، ليس هناك قانون دولي مكتوب، عدا مشروع النظام اﻷساسي، يعرّف هذه الجرائم بوصفها جرائم يمكن أن يساءل عنها اﻷفراد جنائيا ويلاحقوا قضائيا.

Assuming that that paragraph does not prohibit the imposition of punishments under international customary law and that " aggression " , " serious violations of the laws and customs applicable in armed conflict " and " crimes against humanity " constitute crimes under international customary law, it is considered permissible, under that Covenant, for the International Criminal Court to impose punishments for these crimes.

6. The crimes within the jurisdiction of the future international criminal court are listed in article 20 of the Commission's draft: genocide, aggression, serious violations of the laws and customs applicable in armed conflict (the Hague Conventions of 1899 and 1907), crimes against humanity.
٦ - وردت في المادة ٢٠ من مشروع لجنة القانون الدولي الجرائم الداخلة في اختصاص المحكمة الجنائية الدولية المقبلة وهي: جريمة إبادة اﻷجناس، والعدوان، والانتهاكات الجسيمة للقوانين واﻷعراف التي تسري على المنازعات المسلحة )اتفاقيات لاهاي لعامي ١٨٩٩/١٩٠٧(، والجرائم ضد اﻹنسانية.

The delegations favouring the suggested new approach generally agreed that the sphere of inherent jurisdiction should extend to crimes against humanity and to war crimes, the latter category being intended to encompass, according to a number of delegations, not only serious violations of the laws and customs of war, but also crimes under the 1949 Geneva Conventions.

1. Article 20 of the draft statute provides that the International Criminal Court has jurisdiction over the crimes of " genocide " , " aggression " , " serious violations of the laws and customs applicable in armed conflict " , and " crimes against humanity " , but it contains no provisions for the requisites constituting these crimes.
١ - تنص المادة ٢٠ من مشروع النظام اﻷساسي على أن المحكمة الجنائية الدولية تختص بالنظر في جرائم " الابادة الجماعية " ، و " العدوان " ، و " الانتهاكات الجسيمة للقوانين واﻷعراف التي تسري على المنازعات المسلحة " ، " والجرائم ضد الانسانية " ؛ إلا أنها لا تتضمن أحكاما للمقومات اﻷساسية التي تشكل هـذه الجرائــم.

The first was that of crimes under general international law, which were listed in subparagraphs (a) to (d), namely genocide, aggression, serious violations of the laws and customs of war and crimes against humanity, the precise definition of which had been left to the draft Code of Crimes against the Peace and Security of Mankind.
