The value of the judiciary and judicial proceedings has been underpinned by the development of the Johannesburg Principles on the Role of Law and Sustainable Development, which were adopted at the Global Judges' Symposium held in Johannesburg, South Africa, from 18 to 20 August 2002.
وقد أُبرزِت قيمة الهيئة القضائية والإجراءات القضائية بفعل وضع مبادئ جوهانسبرغ المتعلقة بدور القانون والتنمية المستدامة التي اعتمدتها ندوة القضاة العالمية التي عقدت في جوهانسبرغ بجنوب أفريقيا في الفترة من 18 إلى 20 آب/أغسطس 2002.

Taking note of the report of the Special Rapporteur and the reference therein to the Johannesburg Principles on National Security, Freedom of Expression and Access to Information adopted by a group of experts meeting in South Africa on 1 October 1995 which are annexed to that report (E/CN.4/1996/39),

The Symposium adopted the Johannesburg Principles on the Role of Law and Sustainable Development, which refer explicitly to the Universal Declaration of Human Rights and international human rights law and recognize their close connection with sustainable development and upholding the rule of law.
واعتمدت الندوة مبادئ جوهانسبرغ لدور القانون والتنمية المستدامة(13)، التي تعكس بوضوح الإعلان العالمي لحقوق الإنسان والقانون الدولي لحقوق الإنسان وتسلِّم بصلتها الوثيقة بالتنمية المستدامة وبالتزامها بسيادة القانون.

Furthermore, principle 22 (b) of the Johannesburg Principles provides that “[i]n no case may a civilian be tried for a security—related crime by a military court or tribunal”.

In this regard, the Special Rapporteur would like to refer to principle 22 (a) of the Johannesburg Principles which clearly provides that the trial of persons accused of security—related crimes by judges without security of tenure constitutes prima facie a violation of the right to be tried by an independent tribunal.
