Having concluded its consideration of communication No. 1900/2009 submitted to the Human Rights Committee by Fatima Mehalli under the Optional Protocol to the International Covenant on Civil and Political Rights,

3.1 The author alleges that the State party is guilty of a violation of articles 2 (para. 3), 7, 9 and 16 of the Covenant in respect of her father, Mohamed Mehalli, who has disappeared.
3-1 تدعي صاحبة البلاغ أن الدولة الطرف قد انتهكت الفقرة 3 من المادة 2 والمواد 7 و9 و16 من العهد فيما يتعلق بوالدها محمد محالي الذي أصبح مفقودا.

7.5 The Committee also takes note of the anguish and distress caused to the author by Mohamed Mehalli's disappearance, as well as acts of harassment and ill-treatment of various members of her family.
7-5 وتحيط اللجنة علماً بما عانته صاحبة البلاغ من قلق وضيق من جراء اختفاء محمد محالي إضافة إلى أفعال المضايقة وإساءة المعاملة التي تعرض لها عدة أفراد من أسرتها.

The Committee concludes that Mohamed Mehalli's enforced disappearance since 29 June 1998 placed him outside the protection of the law and deprived him of his right to recognition as a person before the law, in violation of article 16 of the Covenant.
وتخلص اللجنة إلى أن الاختفاء القسري لمحمد محالي منذ 29 حزيران/يونيه 1998 قد حرمه من حماية القانون ومن حقه في الاعتراف بشخصيته القانونية الأمر الذي ينتهك المادة 16 من العهد.

ويرجى الإفادة إن كانت الدولة الطرف قد أجرت تحقيقاً عقب ورود معلومات تتحدث عن تعرض السيد عبد الرحمن محالي لسوء المعاملة والاعتداء الجنسي على أيدي عناصر مديرية الاستخبارات والأمن أثناء احتجازه في مكان سري.
