" 2- في اجراءات الاعسار التي تستهل في دولة غير الدولة التي يقع فيها مقر المحيل، اذا نشأ أي حق تفضيلي بمقتضى قانون دولة المحكمة وأعطي الأولوية على حقوق محال اليه في اجراءات اعسار تنظم في اطار قانون تلك الدولة، تكون لذلك الحق تلك الأولوية بصرف النظر عما تنص عليه المادة 24.

وقيل ان من الضروري تزويد المدين بآلية سهلة لابراء ذمته من المسؤولية وأنه لا يمكن أن نتوقع منه أن يتعرف على المُطالب صاحب الحق من بين أكثر من محال اليه فيما يختص بالمستحقات نفسها .
