205. In this regard, the Special Rapporteur strongly urges all Governments to ensure that press offences are no longer punishable by terms of imprisonment, except in cases involving racist or discriminatory comments or calls to violence.

49. CNDH notes with satisfaction that, despite some attempts to curtail the freedom of the press, there is a degree of freedom of expression. It applauds the Government's efforts, particularly the decriminalization of offences against the press laws.
49- رغم تعرض حرية الصحافة لبعض الانتهاكات، لاحظت اللجنة الوطنية لحقوق الإنسان بارتياح وجود هامش لممارسة حرية التعبير ورحبت بالجهود التي تبذلها الحكومة لا سيما فيما يتعلق بإلغاء تجريم مخالفات الصحافة(76).

At the same time, the Special Rapporteur voiced his concern at some provisions of the draft, in particular articles 53, 55, paragraphs 2 and 3, and 57, in accordance with which press offences, as well as the publication of information considered as State secrets, would be punishable by terms of imprisonment of from 2 to 8 years.
وفي الوقت ذاته، أعرب عن قلقه إزاء بعض الأحكام الواردة في المشروع ولا سيما المادة 53 والفقرتين 2 و3 من المادة 55 والمادة 57 التي تنص على معاقبة مخالفات الصحافة ونشر المعلومات المعتبرة من أسرار الدولة بعقوبة الحبس لمدد تتراوح بين عامين و8 أعوام.

In this connection, the Government informed that, in 2004, the President of the Republic of Senegal had agreed that press offences should be de-criminalized.
وفي هذا الصدد، أفادت الحكومة بموافقة رئيس جمهورية السنغال في عام 2004 على ضرورة عدم تجريم مخالفات الصحافة(63).

Laws relating to press offences had been repealed.

8. Decriminalizing press offences

102. To decriminalize press offences, and to create an action plan aimed at greater media freedom and plurality of media (United States of America);

In the context of the sentencing of Rafael Marques and of the content of the new draft press law, the Special Rapporteur wishes to reiterate that, as recommended in his previous report to the Commission on Human Rights (E/CN.4/2000/63), Governments should, in accordance with international standards, " ensure that press offences are no longer punishable by terms of imprisonment " .

In the light of the large number of allegations received relating to the abuse of libel and defamation laws, the Special Rapporteur would like to recall the recommendation made in his report last year (E/CN.4/2000/63, para. 205) that Governments should ensure that press offences are no longer punishable by terms of imprisonment, except in cases involving racist or discriminatory comments or calls to violence.
322- وفي ضوء ارتفاع عدد الادعاءات الواردة بشأن إساءة استعمال قانوني التشهير والقذف، يود المقرر الخاص أن يذكر بالتوصية التي قدمها في تقريره في العام الماضي (E/CN.4/2000/63 الفقرة 205) والتي دعا فيها الحكومات إلى ضمان عدم معاقبة مخالفات الصحافة بالحبس، باستثناء الحالات المتصلة بتعليقات عنصرية أو تمييزية أو بالدعوة إلى ممارسة العنف.
