54. The plenary of the Compliance Committee recalled that appeals to the CMP under the procedures and mechanisms are available on the basis of due process only and recognized that issues of conflict of interest may raise such due process concerns.

However, the Working Group agreed to revise the fourth sentence of paragraph 37 along the following lines: " The appointing court may consider the qualifications required to perform the functions to be undertaken, as well as issues of conflict of interest and will typically outline the terms under which the appointee is authorized to act and the extent of its powers. "

96. Ms. Motoc said that the axiom that justice must not only be done but must be seen to be done was a principle that had originated in English law but which was now very widely accepted, notably by the European Court of Human Rights and was of much wider application than the case cited, also covering issues of conflict of interest that might apply to a judge.
