Article 4.1 of the Convention allowed for temporary special measures for the purpose of achieving substantive equality of women and men and General Recommendation 25 clearly stated that the application of such measures was not discriminatory action. Yet there seemed to be a lack of understanding of the concepts of substantive equality and temporary special measures in Slovakia.

26. The Committee recommends that the State party use temporary special measures, in accordance with article 4, paragraph 1, of the Convention and the Committee's general recommendation No. 25, as part of a necessary strategy to accelerate the achievement of substantive equality for women, especially in the judiciary and the civil service, including the foreign service.

The understanding of gender equality for the purpose of the present survey is that elaborated by the Committee on the Elimination of Discrimination against Women, which clarified that: " ... a purely formal legal or programmatic approach is not sufficient to achieve women's de facto equality with men, which the Committee interprets as substantive equality.

The Committee is however concerned that these measures have not been effective in enhancing equality in the participation of women in political life, or achieving substantive equality for all women in accordance with article 4(1) of the Convention.
