As representatives are aware, the election of judges will take place in accordance with the relevant provisions of article 13 ter of the Statute of the International Tribunal.
وكما يدرك الممثلون، فان انتخاب القضاة سيجري وفقا للأحكام ذات الصلة من المادة 13 مكررا ثالثا من النظام الأساسي للمحكمة الدولية.

He further advised them that, should they decide to nominate a candidate or candidates, then, in accordance with paragraph 1 (b) of article 13 ter of the Statute of the International Tribunal, they should take into account the importance of a fair representation of female and male candidates.

6. Article 13 quater of the statute of the Tribunal indicates that, during the period in which the ad litem judges are appointed to serve in the Tribunal, they shall benefit from the same terms and conditions of service, mutatis mutandis, as the permanent judges of the International Tribunal.
6 - وتنص المادة 13 مكررا ثالثا من النظام الأساسي للمحكمة على أن يستفيد القضاة المخصصون، خلال الفترة التي يُعيَّنون فيها للعمل في المحكمة، من الشروط والأحكام، المعدّلة بحسب الاقتضاء، التي تنطبق على القضاة الدائمين للمحكمة الدولية.

In fact, within the meaning of article 100 quater of the Swiss Penal Code (www.admin.ch/ch/f/rs/311_0/a100quater.html), a crime or an offence committed by employees of a company while carrying out normal business activities consistent with the company's objectives is imputed to the company if it cannot be imputed to any individual owing to the company's lack of structure.
وتعتبر المادة 100 مكررا ثالثا من القانون الجنائي السويسري (( www.admin.ch/ch/f/rs/311_0/a100quater.html أن المسؤولية عن أي جريمة أو جنحة ترتكب في مؤسسة في إطار ما تقوم به من أنشطة تجارية مطابقة لأهدافها تقع عليها، إذا تعذر إسنادها إلى شخص طبيعي بعينه بسبب قصور في تنظيم المؤسسة.

3. By its resolution 1512 (2003) of 27 October 2003, the Security Council decided to amend articles 11 and 12 quater of the statute of the International Criminal Tribunal for Rwanda, thereby authorizing the use of a maximum at any one time of nine ad litem independent judges.
3 - وقرر مجلس الأمن في قراره 1512 (2003) المؤرخ 27 تشرين الأول/أكتوبر 2003 تعديل المادتين 11 و 12 مكررا ثالثا من النظام الأساسي للمحكمة الدولية لرواندا، آذنا بذلك باستخدام عدد أقصاه تسعة قضاة مستقلين مخصصين في أي وقت من الأوقات.

In accordance with article 12 quater of the ICTR statute, ad litem judges will still not participate in the adoption of Rules of Procedure and Evidence, the review of indictments, consultations held by the President in relation to the assignment of judges pursuant to article 13 of the statute or in relation to a pardon or commutation of sentence pursuant to article 27 of the statute.

72. Paragraph 1 (a) of article 13 quater of the Statute of the Tribunal specifies that during the period in which they are appointed to serve in the Tribunal, ad litem judges shall benefit from the same terms and conditions of service mutatis mutandis as the permanent judges of the Tribunal.

In order to streamline procedures and hence respect the spirit of the reform of the ad litem judges, I would propose to the Security Council that the wording specifying that these judges do not have the power to " adjudicate in pre-trial proceedings " should be deleted from article 13 quater of the Statute.
ولكفالة تعجيل الإجراءات، وانطلاقا من فكرة إصلاح عمل القضاة الخاصين بدعوى لذلك فإني أقترح عليكم إلغاء الشروط الواردة في المادة 13 مكررا ثالثا من النظام الأساسي والتي تنص على " عدم إمكانية إبداء رأيهم خلال مرحلة ما قبل المحاكمة " .

In this respect, the International Tribunal is extremely grateful to the Council for having adopted resolution 1660 (2006), which amended Article 12 and Article 13 quater of the Statute increasing the number of ad litem Judges from 9 to 12 and allowing for the assignment of Reserve Judges to these trials.
