142. The Commission agreed that any explanatory material to article 17 undecies should clarify that the court could exercise jurisdiction on arbitration matters, whether the place of arbitration is located in the enacting State or in another State and that the provision should not be construed as expanding the territorial jurisdiction of courts.
142- واتفقت اللجنة على أنه ينبغي لأي ملحوظة إيضاحية للمادة 17 مكررا عاشرا أن تبيّن أن باستطاعة المحكمة ممارسة الاختصاص في مسائل التحكيم سواء أكان مكان التحكيم واقعا في الدولة المشترعة أم في دولة أخرى وأنه ينبغي عدم تأويل هذا الحكم على أنه يوسّع الاختصاص الإقليمي للمحاكم.

138. It was suggested that the text of article 17 undecies might be simplified, along the following lines: " A court shall have the same power of issuing an interim measure in relation to arbitration proceedings as it has in relation to proceedings in the courts, including in cases where the place of the arbitration proceedings is in a State other than the court's.
